NYSTRS Sick Leave Conversion: Section 41-j Service Credit and District Rules
You spent 30 years never calling in sick, and now you have 400 accumulated sick days on the books. What happens to them when you retire? NYSTRS rules determine whether eligible unused leave adds service credit; your school district's collective bargaining agreement governs any separate sick-leave payout or health-insurance benefit.
What Section 41-j Actually Does
Section 41-j of the Retirement and Social Security Law allows eligible unused sick leave to provide additional service credit in the NYSTRS retirement calculation. It does not create a monetary credit against health-insurance premiums. Any separate sick-leave payout or health-insurance benefit is governed by district policy and the applicable collective bargaining agreement.
NYSTRS determines how eligible leave is converted to service credit under Section 41-j. The CBA controls separate district benefits, such as sick-leave cash-outs or health-insurance premium credits.
How the Conversion Works
For Section 41-j service credit, the process generally follows this pattern:
- You retire and your district reports your eligible unused sick leave to NYSTRS
- NYSTRS determines the additional service credit allowed under Section 41-j
- The service credit is included in the pension calculation; it is not a health-premium payment
- Any separate health-insurance premium credit or cash payout is handled under district policy and the applicable CBA
Separate district benefits can use different formulas. For example, if a CBA provides a $50-per-day health-premium credit, 400 eligible days would equal a $20,000 credit; check your district's terms before using an example like this to estimate your benefit.
What Sick Leave Cannot Do
There are common misconceptions about sick-leave conversion:
It does not convert every unused day into a full service day. Section 41-j may add service credit for eligible unused leave, but the number of days does not automatically translate one-for-one into years; NYSTRS determines the credit under its rules.
It does not increase your FAS. Sick-leave payouts or conversion credits do not count as reportable salary. They are excluded from the Final Average Salary calculation across all tiers.
Section 41-j does not create a cash payout or health-premium offset. Some districts offer separate cash payouts or premium credits under a CBA. Those are district-level benefits, not the Section 41-j service credit; cash payouts for unused leave are generally excluded from NYSTRS FAS.

Check Your CBA Before You Retire
These are the specific items to look for in your collective bargaining agreement:
- Does your district offer a separate sick-leave payout or health-premium credit? These benefits are controlled by district policy and the CBA.
- What rate and day limits apply to that district benefit? Check the CBA; district terms differ.
- What is the notice deadline? Some districts require notice by a specified date to qualify for a local benefit.
- How does the NYSTRS service-credit calculation work? Confirm eligible leave and the resulting credit with NYSTRS.
Your district HR office can explain local payouts and health-insurance terms. NYSTRS determines Section 41-j service credit from the eligible leave the district reports.
Timing Matters
Your district reports eligible unused sick leave to NYSTRS as part of its end-of-service data. If that report is delayed, the Section 41-j service credit may not be included in the initial pension calculation. Ask district HR whether the leave was reported and ask NYSTRS when the service-credit calculation will be updated.
For a separate health-insurance premium credit, contact district HR about the applicable CBA and when the district will apply it. NYSTRS's Section 41-j service credit is a separate pension calculation.
