How NYSLRS Sick Leave Converts to Pension Credit
Under RSSL Section 41(j), your employer can elect to let retiring employees convert unused sick leave into additional pension service credit. Not every employer participates — check with your agency's HR office before assuming this benefit is available to you.
If your employer does participate, the number of sick days you can convert depends on your tier and employer:
- ERS Tiers 2 through 5 and PFRS: Up to 165 days of unused sick leave can count toward additional service credit.
- ERS Tier 6: Up to 100 days.
- Designated New York State negotiating units: Up to 200 days.
To calculate service credit, divide unused sick-leave hours by standard workday hours to get days, then divide the days by 260 to get additional service-credit years. Sick leave credit cannot be used to meet vesting, age or service thresholds for a higher benefit multiplier, or service requirements for a special 20- or 25-year plan.
Why the Cap Difference Matters
A Tier 4 member with 165 unused sick days could gain roughly 7.6 additional months of service credit. A Tier 6 member maxes out at about 4.6 months from 100 days. The additional credit affects the pension calculation for the member's lifetime.
The monthly pension effect depends on the member's tier, Final Average Salary, and credited service. Request an estimate that includes the sick-leave credit to see the amount for your record.
For Tier 6 members, the 100-day cap produces a smaller bump, and the gap widens further because Tier 6 members generally have fewer accumulated sick days given their shorter tenure in the system.
The NYSHIP Health Premium Credit Alternative
Here's where many retiring employees get stuck: if your employer participates in both Section 41(j) and the NYSHIP sick leave credit program, you face a binary choice. Your unused sick leave can go toward pension service credit or toward a monthly NYSHIP health insurance premium credit — not both.
The NYSHIP premium credit converts unused sick-leave hours and your hourly pay rate into a total dollar value, then divides that amount by actuarial life expectancy in months to calculate the monthly premium credit.
When the NYSHIP credit may be worth comparing: If you already have substantial service credit, compare the monthly premium credit with the pension increase shown in an estimate that includes sick leave.
When the pension credit may be worth comparing: The additional service credit can increase the pension calculation, but it cannot be used to meet a service or age threshold for a higher multiplier or a special 20- or 25-year plan.

How to Evaluate the Trade-Off
Your pre-retirement counseling session with NYSLRS is the place to get exact numbers. Before that meeting, gather:
- Your current sick leave balance from your employer's payroll system
- Your Retirement Online benefit estimate showing the Single Life Allowance
- A second estimate that includes the additional sick leave service credit
- Your current NYSHIP premium and the retiree rate for your coverage tier
Compare the monthly pension increase from the Section 41(j) credit against the NYSHIP premium credit calculated for your coverage. Consider how each amount is determined and adjusted over time before choosing.
Make the Decision Before Your Retirement Date
Both elections must be finalized before you separate from active payroll. The NYSHIP sick leave credit preservation form (PS-410) goes through your employer's Health Benefits Administrator, not through NYSLRS directly. If you're choosing the pension route, your employer reports the sick leave days to NYSLRS as part of your final payroll certification.
Don't wait until the last week. Coordinate with both your HR office and NYSLRS to confirm which option your employer supports and get the paperwork moving at least 60 days before your retirement date.
