NYSLRS Sick Leave Pension Conversion Under Section 41(j)
How Section 41(j) Works
Where your employer offers it, RSSL Section 41(j) or 341(j) lets eligible NYSLRS members use accumulated, unpaid sick leave for additional pension service credit at retirement. Your employer certifies the eligible hours, and NYSLRS adds the service credit to your total.
NYSLRS converts hours into days using the standard workday hours, then calculates additional service credit using a 260-day service year.
Tier-Based Caps
Not everyone gets the same maximum. The number of sick leave days eligible for conversion depends on your tier, plan, and negotiating unit:
- ERS Tiers 2–5 and PFRS: Up to 165 days (approximately 7.6 months of additional service credit)
- ERS Tier 6: Up to 100 days (approximately 4.6 months of additional service credit)
- Designated New York State negotiating units: Up to 200 days (approximately 9.2 months of additional service credit)
These caps apply regardless of how many sick days you've actually accumulated. A Tier 6 member with 200 unused sick days can convert only 100 of them to pension credit.
The NYSHIP Alternative
Here's where the decision gets complicated. Instead of converting sick leave to pension service credit, you can use it toward a lifetime NYSHIP retiree health insurance premium credit. The credit reduces what you pay for health coverage in retirement — potentially for decades.
The two paths are administered separately: your employer's Health Benefits Administrator (HBA) handles NYSHIP, while NYSLRS handles pension service credit. Confirm with both offices which portions of your balance are eligible for each credit.

Which Path Pays More
The answer depends on your specific situation — there's no universal winner:
Pension credit favors you when:
- You have a high Final Average Salary (the additional service months multiply against your FAS)
- You have already reached a benefit formula breakpoint; sick leave credit cannot be used to reach a higher multiplier threshold
- Your employer doesn't participate in NYSHIP or offers limited retiree health coverage
NYSHIP premium credit favors you when:
- Your health insurance premiums in retirement will be substantial (family coverage, Empire Plan or HMO)
- You're in ERS Tier 6, where the 100-day cap limits the pension credit
- The monthly pension increase from the additional credit would be relatively small
The pension credit adds service based on eligible sick leave days divided by 260. A NYSHIP premium credit is calculated from unused sick leave hours multiplied by the hourly pay rate, then divided by the retiree's actuarial life expectancy in months. Compare your NYSLRS estimate with the credit amount your HBA calculates.
Timing Matters
Ask your employer or HBA to confirm the eligible sick leave balance before your retirement date. Work with HR or the HBA at least three months before you retire to understand the applicable rules.
Confirm the available pension service credit with NYSLRS and the NYSHIP premium credit with your HBA before retirement.
