NYSTRS Death Benefit After Retirement and Beneficiary Changes
One of the most misunderstood pieces of NYSTRS retirement is what happens to your benefits when you die. The answer depends on which payout option you elected — and on a separate death benefit most retirees do not even know they have.
The Paragraph 2 Post-Retirement Death Benefit
Independently of your pension option election, NYSTRS provides a lump-sum death benefit known as the Paragraph 2 post-retirement death benefit. It is separate from your monthly pension-option payments.
For eligible Tier 2 through Tier 6 retirees, the Paragraph 2 benefit pays a lump sum to your designated beneficiary when you die. The amount and any age-related reductions depend on NYSTRS rules and your benefit record; review the death-benefit information in your Benefit Profile or confirm your estimate with NYSTRS.
Coverage continues automatically after retirement at no cost to you. You do not need to enroll, and there are no premiums deducted from your pension. Tier 1 members have different death benefit provisions under their original plan rules.
How Your Pension Option Determines Ongoing Payments
The Paragraph 2 benefit is a one-time lump sum. Whether your monthly pension payments continue to anyone after your death depends entirely on the option you selected when you retired:
Maximum Benefit: All monthly pension payments stop at your death. No ongoing payments to any beneficiary. This option provides the highest monthly check to you but nothing to survivors.
Joint & Survivor (100%, 75%, or 50%): Your named beneficiary receives the elected percentage of your reduced monthly payment for the rest of their life. If your beneficiary dies before you, your monthly payment remains at the reduced level permanently — you cannot revert to the Maximum or name a new beneficiary.
Pop-Up Survivor: Works like Joint & Survivor, but if your beneficiary dies before you, your monthly payment "pops up" to the Maximum amount. The trade-off is a lower initial monthly payment than the equivalent standard Joint & Survivor option.
5-Year or 10-Year Guarantee: If you die within the guarantee period, your beneficiary receives the remaining months of payments. If you outlive the guarantee period, payments stop at your death.
Changing Your Beneficiary After Retirement
This is where the rules get strict. Your ability to change beneficiaries depends on which option you elected:
Maximum Benefit: There is no pension beneficiary to change. You can update the beneficiary for the Paragraph 2 death benefit at any time by contacting NYSTRS or updating through MyNYSTRS.
Joint & Survivor or Pop-Up options: You cannot change your pension beneficiary after the 30-day post-retirement window closes. The election is permanently irrevocable. This is true even if you divorce, if your beneficiary dies, or if your circumstances change in any other way. The person you named at retirement is locked in.
Guarantee options (5-Year or 10-Year): You may name new primary or contingent beneficiaries at any time during your life by filing updated forms with NYSTRS.
The Paragraph 2 death benefit beneficiary is always changeable, regardless of your pension option. Many retirees confuse these two designations — the pension option beneficiary and the Paragraph 2 beneficiary are separate elections with different rules.

What to Do Before You Retire
Review your beneficiary designations before filing your retirement application. If you have a Domestic Relations Order (DRO) from a divorce, the court order may restrict which option you can elect or require you to name your former spouse. Confirm with the NYSTRS Legal Department before filing.
