NYSTRS Benefit Option Election: The 30-Day Window and What You Can't Undo
When You Choose
You select your payout option on Form RET-54 — the retirement application itself. That choice determines whether your pension stops at your death (Maximum), continues to a beneficiary (Joint & Survivor or Pop-up), or is guaranteed for a fixed period (5-year or 10-year Guarantee).
The election is provisional for exactly 30 calendar days after your effective retirement date. During that window, you can change your option or beneficiary by filing Form RET-54.6.
On day 31, the election is permanently irrevocable. No appeal, no exception, no do-over.
What Form RET-54.6 Can and Can't Do
Within the 30-day window, RET-54.6 lets you:
- Switch from one option to another (e.g., Maximum to 100% Joint & Survivor)
- Change your named beneficiary
- Move between Pop-up and non-Pop-up variants of the same option
It cannot change your effective retirement date (that window closes at day 14) or reverse the retirement itself.
RET-54.6 requires your signature and notarization and is filed on paper. Send it promptly, allowing enough time to meet the 30-day deadline; confirm NYSTRS's current delivery instructions.
Spousal Consent
Unlike federal ERISA-governed plans, NYSTRS does not legally require your spouse's signature or consent to elect the Maximum single-life option. You can choose the highest monthly payout without your spouse agreeing.
That said, if a Domestic Relations Order (DRO) is on file from a divorce, it can legally compel a specific option — typically a Joint & Survivor election naming the former spouse as beneficiary. If you're divorced and haven't checked whether a DRO restricts your options, do that before filing.
Couples who disagree about the option decision should work it out before the retirement date. Once the 30-day window closes, the chosen option stays for life. If you picked a Joint & Survivor option and your beneficiary predeceases you (and you didn't choose the Pop-up variant), your benefit remains permanently reduced.

Choosing the wrong option costs money every month for the rest of your life. The size of the reduction depends on your age and your beneficiary's age; compare NYSTRS's option estimates for your specific circumstances.
There's no formula that works for everyone. A teacher whose spouse has their own pension and health coverage faces a completely different calculation than one whose spouse depends entirely on the teacher's income.
