FRS Survivor Benefits and Social Security After GPO Repeal
For decades, two federal rules—the Government Pension Offset and the Windfall Elimination Provision—could reduce or eliminate Social Security benefits for people receiving public pensions. Some FRS survivor families were told they'd get little or nothing from Social Security because of these offsets, and many never bothered to apply.
That's over. Both rules were fully repealed on January 5, 2025, retroactive to January 2024.
What Changed
The Social Security Fairness Act (H.R. 82) eliminated both the GPO and the WEP:
The Government Pension Offset had reduced Social Security spousal and survivor benefits by two-thirds of the recipient's own public pension amount. For many surviving spouses receiving FRS benefits, this wiped out their Social Security survivor benefit entirely.
The Windfall Elimination Provision had reduced the Social Security retirement benefit for workers who split their career between Social Security-covered and non-covered employment.
Both provisions are now gone—not just going forward, but retroactively for all benefits payable from January 2024 onward.
Most Standard FRS Members Were Never Affected
Most Florida FRS-covered public employment participates fully in Social Security, meaning the standard FRS member already pays FICA taxes and earns Social Security credits alongside their pension. For these members, WEP and GPO were never relevant.
The offsets mattered for FRS members who also had non-covered service in other states' pension systems or in federal civil service before 1984. If your spouse worked in one of those roles and also had FRS service, the repeal may affect your benefits.
Two Paths for Survivors After the Repeal
If you were already receiving a reduced Social Security benefit: The Social Security Administration automatically adjusted monthly payments and issued retroactive lump-sum payments covering the difference back to January 2024. SSA began issuing retroactive adjustments in February 2025 and has completed implementation. If your payments haven't been adjusted, contact the Social Security Administration.
If you never applied because GPO would have zeroed your benefit: SSA does not automatically enroll you. You must file a new application directly with the Social Security Administration. There is no automatic back-payment for people who never filed a claim. The sooner you apply, the sooner payments begin.

What This Means for FRS Survivor Planning
FRS survivors may be eligible for Social Security spousal or survivor benefits without the former GPO reduction. Social Security eligibility and benefit amounts are still determined under SSA rules.
This matters most for surviving spouses who were previously deterred from applying because of the GPO. They can now apply for Social Security, with eligibility and payment amounts determined under SSA rules.
State Plan Offsets Still Exist
The federal GPO repeal doesn't touch state-level pension provisions. Some state pension systems have their own internal offsets for members with dual-plan service. These are plan provisions, not the federal GPO, and they remain in effect. Standard FRS benefits have no such internal offset.
Action Steps
- Check whether you're currently receiving a reduced Social Security benefit—your benefit statement will show whether a GPO or WEP adjustment was applied
- If reduced, verify that SSA has already corrected your payment amount and sent retroactive pay
- If you never applied for Social Security because of the offsets, file a new claim with SSA immediately
- Keep your FRS survivor benefit claim and Social Security claim as separate processes—they're administered by different agencies with different timelines
