VRS Retirement and Social Security After WEP Repeal

If you have been told that your VRS pension will reduce your Social Security benefits, that information is out of date. The Social Security Fairness Act (H.R. 82), signed into law on January 5, 2025, repealed both the Windfall Elimination Provision (WEP) and the Government Pension Offset (GPO) retroactively to January 2024. The SSA completed implementation and paid retroactive adjustments starting February 2025.

Here is what the repeal actually means for VRS members — and what it does not change.

What WEP and GPO Were

The Windfall Elimination Provision reduced Social Security retirement benefits for people who earned a pension from employment not covered by Social Security. The Government Pension Offset reduced Social Security spousal and survivor benefits by two-thirds of the person's government pension.

Both provisions targeted workers who split careers between Social Security-covered and non-covered employment. The theory was that the Social Security benefit formula, designed to be progressive, would otherwise over-credit workers who had substantial earnings from non-covered pensions.

Why Most VRS Members Were Never Affected

Standard VRS members — state employees, public school teachers, and political subdivision workers — pay FICA taxes throughout their public employment. Their VRS service is Social Security-covered employment. Because WEP only applied to pensions from non-covered employment, it did not reduce Social Security benefits for the vast majority of VRS members.

The members who were affected fell into narrower categories: those with outside non-covered public service (such as prior employment under a system that did not participate in Social Security), or spouses and survivors of workers with non-covered pensions.

What the Repeal Changes

For VRS members who had non-covered service elsewhere, the WEP reduction on their Social Security retirement benefit is eliminated. If SSA was already paying you a reduced benefit, the adjustment was automatic — you should have received retroactive payments back to January 2024.

For spouses and survivors of workers with non-covered pensions, the GPO offset is gone. If you never applied for a spousal or survivor Social Security benefit because the GPO would have wiped it out, you need to file a new application with SSA. This is not automatic — SSA cannot pay benefits you have not claimed.

What the Repeal Does NOT Change

The repeal does not affect the VRS Advance Pension Option (APO). Some online sources incorrectly claim that APO was eliminated or made obsolete by the WEP/GPO repeal. APO is an internal VRS plan feature — it temporarily increases your VRS pension before a selected age (between 62 and your Social Security Normal Retirement Age) and permanently reduces it afterward. The repeal of federal provisions has no bearing on this VRS-administered bridge mechanism.

The repeal also does not affect state-level pension plan offsets. If a plan has its own internal coordination or offset provision (such as coordinated-member offsets in some state pension systems), those are plan-level rules, not federal WEP/GPO, and they remain in place.

What to Do Now

If you previously had Social Security benefits reduced under WEP or GPO, verify that SSA has processed your adjustment. Sign in to your Social Security account or contact your local SSA office to confirm the retroactive payment and your new ongoing benefit amount.

If you never applied for spousal or survivor Social Security benefits because WEP or GPO would have eliminated them, file a claim now. The repeal is retroactive to January 2024, so you may be owed back payments.

If you are approaching VRS retirement and considering the Advance Pension Option as a Social Security bridge, the APO remains available and unchanged. The decision of whether to use APO depends on your retirement age, your Social Security claiming strategy, and your tolerance for the permanent post-bridge reduction — not on the WEP/GPO repeal.
