CalSTRS Survivor Benefits and Social Security After GPO Repeal
What Changed on January 5, 2025
The Social Security Fairness Act (H.R. 82), signed into law on January 5, 2025, repealed two provisions that had reduced or eliminated Social Security benefits for California educators and their surviving spouses for decades:
Government Pension Offset (GPO): Previously reduced Social Security spousal and survivor benefits by two-thirds of the person's non-covered government pension. For many CalSTRS survivors, this zeroed out their entire Social Security survivor benefit.
Windfall Elimination Provision (WEP): Reduced Social Security retirement or disability benefits for workers who also earned a non-covered pension.
Both are fully repealed. The repeal applies retroactively to benefits payable for months after December 2023 — meaning from the January 2024 benefit month onward.
What This Means for CalSTRS Survivors
If you're the surviving spouse of a California educator and you receive (or are eligible for) Social Security survivor benefits based on your deceased spouse's work record, those benefits are no longer reduced by GPO. The offset is zero.
This matters most for survivors whose CalSTRS pension is large relative to the Social Security benefit. Under the old rules, a CalSTRS pension of $3,000/month triggered a $2,000 GPO reduction — enough to eliminate most Social Security survivor benefits entirely. That reduction is gone.
The repeal does not change CalSTRS pension calculations. CalSTRS benefits are unaffected — the change is on the Social Security side only.
If You're Already Receiving Reduced Benefits
SSA performed automatic recalculations for beneficiaries whose payments were reduced by GPO or WEP between January 2024 and mid-2025. Ongoing monthly payments have been adjusted upward, and retroactive lump-sum backpayments covering the cumulative offset amounts have been issued.
Verify your payment history by logging into your my Social Security account at ssa.gov/myaccount or calling SSA at 800-772-1213. Check that the GPO reduction is removed from your record and that you received the full retroactive amount.

If You Never Applied Because GPO Would Have Eliminated the Benefit
This is the group that needs to act now. SSA does not automatically identify or enroll people who never applied for benefits because GPO would have reduced them to zero.
You must file a new application. Social Security survivor benefit applications cannot be filed online — you need to call SSA at 800-772-1213 (Monday–Friday, 8:00 AM–7:00 PM local time) or visit a local SSA field office to schedule an interview.
If you're also eligible for your own Social Security retirement benefit, those can be filed online at ssa.gov/apply.
The CalSTRS Pension Stays Intact
A common fear among CalSTRS families: does receiving Social Security reduce the CalSTRS pension? No. The Social Security Fairness Act changed federal Social Security law. It did not create any new offset against CalSTRS defined benefit pension calculations. You receive both benefits in full.
Filing Alongside the CalSTRS Claim
Social Security survivor benefits and CalSTRS survivor benefits are entirely separate claims with separate agencies. When an educator dies, the surviving spouse should file with both — CalSTRS for the pension benefits and SSA for Social Security survivor benefits.
