How to Claim Social Security After an Ohio Teacher Dies
Social Security and STRS Ohio Now Stack — But You Have to File
Since the Social Security Fairness Act repealed the Government Pension Offset on January 5, 2025, surviving spouses of Ohio teachers can claim Social Security survivor benefits without a reduction from the STRS Ohio pension. People who never applied because of the offset must file a new claim; SSA does not automatically start paying them.
This is the process for claiming Social Security survivor benefits alongside STRS Ohio benefits.
Two Paths Based on Your Situation
Path A: You were already receiving reduced Social Security benefits. If GPO had previously reduced your Social Security spousal or survivor benefit (or eliminated it entirely), SSA should have automatically recalculated your benefit and issued retroactive payments back to January 2024. Check your SSA notices and my Social Security account at ssa.gov. If you haven't received an adjustment, call SSA at 800-772-1213 to verify.
Path B: You never applied because GPO would have zeroed it out. This is the critical group. Social Security does not automatically enroll you. You must file a new application directly with SSA. Retroactive payments for new claims are limited to 6 months before your application date — so every month you delay beyond that 6-month window is money permanently lost.
If you're in Path B and the teacher died years ago, you may be leaving substantial benefits unclaimed right now. File as soon as possible.
How to File for Social Security Survivor Benefits
- Gather your documents: Your Social Security number, the deceased's Social Security number, certified death certificate, your marriage certificate, your birth certificate, and your bank information for direct deposit
- Call SSA at 800-772-1213 to start the new claim and ask how SSA requires you to file
- Submit the application and supporting documents SSA requests for the survivor claim
- If GPO comes up, reference the Social Security Fairness Act (H.R. 82, signed January 5, 2025), which repealed it

How Much You'll Receive
Social Security survivor benefits for a surviving spouse are based on the deceased's earnings record — their work history that was covered by Social Security taxes. Ohio teachers don't pay Social Security taxes on STRS-covered employment, but they may have:
- Worked in Social Security-covered jobs before, after, or alongside their teaching career
- Paid into Social Security through summer employment, part-time private-sector work, or prior careers
The surviving spouse can receive up to 100% of the deceased's primary insurance amount if claiming at full retirement age, or a reduced amount if claiming earlier (as early as age 60, or age 50 if disabled).
Even if the deceased teacher had only a modest Social Security record, the benefit is now unreduced. A teacher who worked 15 summers in private-sector jobs may have built up a Social Security record that previously would have been wiped out by GPO for their surviving spouse. That full benefit is now payable.
STRS Ohio and Social Security Don't Offset Each Other
These are two independent systems with two independent claims:
- STRS Ohio pays survivor benefits from the state teacher pension fund, based on the member's STRS service credit and Plan of Payment
- Social Security pays survivor benefits from the federal trust fund, based on the member's Social Security-covered earnings
Claiming one does not reduce the other. You keep 100% of both.
The practical sequence:
- Report the death to STRS Ohio (888-227-7877) and begin the pension survivor claim
- Report the death to SSA (800-772-1213) and file for Social Security survivor benefits
- Report the death to Medicare if applicable (especially to adjust Part B enrollment)
Each system processes independently on its own timeline.
