NYSTRS Tier 3 Article 14 Social Security Offset: What It Is and How to Avoid It

The Offset That Surprises Tier 3 Members

If you joined NYSTRS between July 27, 1976 and August 31, 1983, you're a Tier 3 member under Article 14 of the Retirement and Social Security Law. Article 14 includes a provision that many members don't learn about until they're close to retirement: at age 62, your NYSTRS pension is permanently reduced by an amount tied to your Social Security benefit.

This is not the federal WEP or GPO. Those were repealed in January 2025. The Tier 3 Article 14 offset is a New York State plan-level provision that remains fully in effect.

How the Offset Works

When a Tier 3 member retiring under Article 14 rules reaches age 62, NYSTRS reduces the monthly pension by 50% of the Social Security benefit attributable to the member's years of New York State public service.

The reduction is permanent. It doesn't go away at age 65 or at any other milestone. It applies every month for the rest of your life.

Here's a simplified example: if your Social Security benefit attributable to NYS public service is $1,200 per month, the Article 14 offset reduces your NYSTRS pension by $600 per month — $7,200 per year, permanently.

Why WEP Repeal Didn't Fix This

The Social Security Fairness Act (H.R. 82, signed January 5, 2025) repealed the Windfall Elimination Provision and the Government Pension Offset at the federal level. These were reductions applied by the Social Security Administration to Social Security benefits when a recipient also received a government pension from non-covered employment.

The Tier 3 Article 14 offset is a completely different mechanism. It's written into New York State law, not federal law. It reduces your NYSTRS state pension based on your Social Security earnings — the opposite direction. The federal repeal addressed only federal-level reductions. It did not touch state plan-level offsets.

Many online resources and financial advisor blogs blur this distinction, leaving Tier 3 members thinking the 2025 repeal solved their offset problem. It didn't.

How to Avoid the Offset: Elect Tier 4 (Article 15) Rules

New York State law allows virtually all Tier 3 members to retire under Tier 4 (Article 15) provisions instead of Article 14. Tier 4 rules have no Social Security offset at any age.

The tradeoff: Tier 4 rules may apply slightly different pension factor calculations and early retirement reduction rules than Article 14. But for the overwhelming majority of Tier 3 members, the elimination of the age-62 Social Security offset more than compensates for any difference in the pension factor.

This is why nearly every Tier 3 member elects Article 15 at retirement. It's a standard part of the filing process, and NYSTRS representatives can show you the dollar-for-dollar comparison of Article 14 vs. Article 15 benefits in a formal estimate.

What to Do If You're Tier 3

  1. Request a formal NYSTRS benefit estimate that shows both Article 14 and Article 15 projections
  2. Compare the monthly benefit under each option, paying attention to what happens at age 62 under Article 14
  3. Confirm with NYSTRS that you are eligible to elect Article 15 (eligibility is nearly universal for Tier 3 members)
  4. Make the election when you file your retirement application (Form RET-54)

Don't assume your union representative or district HR will flag this for you. The Article 14 offset is tier-specific and not something that comes up in general retirement workshops covering all six tiers.
