NYC TRS Tier 3 Social Security Offset: Article 14 vs Article 15 and the 50% Reduction at Age 62
If you joined NYC TRS between July 27, 1976, and August 31, 1983, your pension may be subject to a 50% Social Security offset starting at age 62. This is not WEP. It is not affected by the 2025 Social Security Fairness Act. It is a built-in feature of New York State's Tier III pension design, and it is still fully in effect.
How the Tier III Article 14 Offset Works
Under RSSL Article 14, Tier III retirement allowances are integrated with Social Security. When a Tier III member reaches age 62, TRS reduces the monthly pension by 50% of the Social Security benefit the member accrued while employed in New York State public service.
The offset begins at age 62 and is based on the Social Security benefit attributed to your New York State public employment, not on your total Social Security record.
The math works like this: if your monthly Social Security benefit attributable to NYS public employment is $2,000, your TRS pension decreases by $1,000 per month starting at age 62. That is a permanent reduction for the rest of your life.
Why This Is Not WEP or GPO
The Windfall Elimination Provision (repealed January 2025) reduced Social Security benefits for workers who had earnings in both covered and non-covered employment. The Government Pension Offset reduced spousal/survivor Social Security benefits for recipients of non-covered government pensions.
The Tier III Article 14 offset operates in the opposite direction — it reduces the TRS pension, not the Social Security benefit. It is a state plan-level integration formula written into New York Retirement and Social Security Law. The federal repeal of WEP and GPO did not touch it.
Financial advisors and online forums frequently conflate these two concepts. If someone tells you that the 2025 repeal eliminated your Tier III pension reduction, they are wrong.
Article 14 vs Article 15: The Critical Tier Election
Members who joined between July 27, 1976, and August 31, 1983, can receive benefits under either Tier III (Article 14) or Tier IV (Article 15). The difference is significant:

For many members in this window, Tier IV/Article 15 produces a higher total retirement income because the Social Security offset does not apply. Your tier election is already on file with TRS. Planning Around the Offset
If you are a Tier III member, the offset makes your income picture look very different before and after age 62. Retirement at 55 or 60 means your TRS pension runs at the full rate for several years before dropping at 62. That cliff can surprise people who planned their budget around the pre-62 amount.
Three things to think about:
Check both records. Use SSA for your Social Security estimate and ask TRS how it calculates the portion attributed to NYS public employment. If you have private-sector earnings, your total SSA benefit can differ from the amount used for the plan-level offset.
Separate the two calculations. The TRS offset is based on the Social Security benefit attributed to NYS public employment. Your SSA claiming decision is a separate calculation; ask TRS how it determines the plan-level offset for your record.
