NYSTRS Retirement Income Tax: What You Owe on Your Pension

Most NYSTRS members spend decades planning their pension benefit, then get blindsided by the tax bill on their first check. The rules are actually straightforward once you separate what the feds take from what New York leaves alone.

Your NYSTRS Pension Is Federally Taxable

NYSTRS service retirement pensions are fully taxable as ordinary income under federal law.

NYSTRS withholds federal taxes from each monthly payment based on the elections you make. If you do nothing, NYSTRS applies default withholding as if you claimed "single" with no adjustments — which usually withholds more than necessary.

New York State Exempts NYSTRS Pensions Entirely

For New York residents, NYSTRS pension payments are 100% exempt from New York State and local personal income taxes, regardless of the amount, filing status, or other income you receive.

This exemption covers your base monthly pension, any cost-of-living adjustments (COLA), and retroactive lump-sum payments that NYSTRS issues when your finalized benefit exceeds interim payments. It does not extend to withdrawals from your 403(b), 457(b), or traditional IRA — those are taxable at the New York State level unless they qualify for the $20,000 pension/annuity exclusion available to taxpayers age 59½ and older.

Setting Up Federal Withholding With Form W-4P

You establish your federal withholding elections when you file your retirement application. There are two paths:

Online through MyNYSTRS: The tax withholding module is integrated into the retirement application workflow. You select your filing status (single, married filing jointly, head of household), claim dependents, and enter any additional withholding amount or deductions. Changes take effect within one to two pay cycles.

Paper Form W-4P: If you file a paper retirement application (Form RET-54), submit a completed W-4P alongside it. NYSTRS processes the form and applies your elections to your first payment.

After retirement, you can update withholding at any time through the MyNYSTRS portal under Tools > Tax Withholding. There is no limit on how many times you can adjust.

Common Tax Situations NYSTRS Retirees Face

Married couples with two pensions. If your spouse also receives a NYSTRS, NYSLRS, or NYC TRS pension, both pensions are exempt from New York State tax. But the combined federal taxable income may push you into a higher marginal bracket than either pension alone.

Part-time work after retirement. Earnings from post-retirement public employment (subject to Section 212 rules) are taxable at both the federal and state level. Only the pension itself is state-exempt, not wages earned in retirement.

The first-year lump sum. When NYSTRS finalizes your benefit 9 to 12 months after retirement, you receive a retroactive lump-sum payment covering the difference between your interim checks and your actual benefit. This lump sum is taxable in the year you receive it, not spread over the months it covers. Plan accordingly if finalization falls in a year where you also had employment income.

What NYSTRS Reports to the IRS

NYSTRS issues Form 1099-R each January for the prior tax year. It reports your total pension payments, the taxable amount, and any federal tax withheld. You will not receive a W-2 from NYSTRS — the 1099-R is the only tax document.

Keep your 1099-R for your records. NYSTRS also transmits the data directly to the IRS, so the numbers on your return must match exactly.
