Why NYSLRS Recalls Pension Deposits After a Retiree Dies
Pension payments are payable through the month of a retiree's death. Any payment for a month after the month of death is an overpayment, and NYSLRS will reclaim it.
After the death is reported, NYSLRS initiates reclamation of later-month direct deposits through the retiree's financial institution. The timing and account handling should be confirmed with the bank. If the pension was paid by paper check, return any uncashed checks to NYSLRS promptly.
This is often the first financial shock a surviving spouse experiences. The household has been relying on that monthly deposit, and it vanishes from the account within days of the death being reported.
How the Clawback Process Works Step by Step
The timeline typically unfolds like this:
- Day of death through day 5. The family or employer reports the death to NYSLRS by phone (1-866-805-0990) or through the online death reporting form. NYSLRS opens a survivor case file.
- Reclamation. NYSLRS's benchmark for reclaiming post-death direct deposits is 5 to 15 business days. Check with the financial institution about when the reversal will post and how the account will be handled.
- Paper checks. Return any uncashed checks for months after the month of death promptly. If a check was already deposited, contact NYSLRS for instructions.
Do not spend pension payments for months after the month of death. The pension payment for the month of death remains payable; payments for later months are subject to recovery.
When Retroactive Survivor Payments Fill the Gap
If the deceased retiree elected a Joint Allowance or Pop-Up Joint Allowance at retirement, the surviving option beneficiary is entitled to a continuing monthly pension — and it pays retroactively to the day after the retiree's death. That means the first survivor payment will include a lump sum covering all the months between the death and the date NYSLRS processes the claim.
For a retiree who died on March 15 with a claim settled in June, the surviving spouse's first payment would include the March 16–June payment as a single retroactive amount, plus the regular monthly amount going forward.
This retroactive payment effectively bridges the gap created by the deposit recall. The money comes back, but it comes back through the survivor benefit channel rather than through the original pension.
If the retiree elected a Single Life Allowance (Option 0), there is no continuing monthly benefit. The clawback stands, and the only payments the family receives are the post-retirement death benefit lump sum and, if eligible, the $3,000 Survivor's Benefit Program payout.

What to Do If NYSLRS Recalls More Than It Should
If the recall amount seems inconsistent with the payment rule or your records, contact NYSLRS Survivor Services at 1-866-805-0990 to ask for a review. Keep your own records: note the date of death, the dates and amounts of every pension deposit in the months surrounding the death, and the exact amount the bank reversed.
If you've submitted the certified death certificate and claim forms, ask NYSLRS how it will reconcile any disputed or excess recall. Do not assume an excess amount will automatically be included in the survivor benefit disbursement.
Protecting the Household During the Gap
NYSLRS's estimated benchmark for the first payment after a retiree's death claim is 45 to 75 days overall. A few practical steps:
- Notify the bank. Alert the branch that an ACH reclamation is coming so it doesn't trigger overdraft fees on autopay bills.
- Set aside the last legitimate deposit. The payment for the month of death is yours to keep. Don't let it get swept up in confusion over which deposit is which.
- File the death certificate promptly. NYSLRS cannot issue claim packets until the certified death certificate with a raised seal arrives in Albany. Every week of delay extends the gap.
