NC Pension Check After Death: The Full Month Check Rule and What to Return

The Month-of-Death Check Is Yours

Under N.C. General Statutes § 135-5, a TSERS retiree is legally entitled to the full pension payment for the calendar month in which they die. If the retiree dies on October 3, the October pension check belongs to the family. If the retiree dies on October 31, the October check still belongs to the family. The date within the month does not matter.

This is not a grace period or an informal practice. It is a statutory rule. The survivor or estate may retain the benefit issued for the month of death without any obligation to return it.

Everything After That Month Must Go Back

Any pension payments deposited for months after the month of death are unearned state funds that must be returned immediately. This is where families get into trouble — especially when direct deposit is involved.

If the retiree's pension was set up for direct deposit and RSD has not yet been notified of the death, the next month's payment will hit the bank account automatically. The family cannot keep it. Under North Carolina law, fraudulently receiving or failing to return a deceased retiree's retirement benefits for two or more months following the death is a Class 1 Misdemeanor.

How Overpayment Recovery Works

Once RSD is notified of the death, they initiate an automated reclamation request through the banking system to recover any post-death deposits. Here is how the process typically plays out:

If the bank account is still open: RSD initiates a reclamation request through the banking system. Contact the bank or RSD to confirm whether the funds were returned; do not assume the request succeeds automatically.

If the bank account has been closed: The automated reclamation may fail, and the estate representative must reimburse the system directly. The overpayment must be resolved before survivor claims or death benefits can be disbursed.

If the funds were spent: The overpaid amount still must be returned. Contact RSD for repayment instructions.

The safest approach: notify RSD of the death immediately, and do not spend any pension funds deposited after the month of death. Leave the bank account open until the reclamation is complete.

The Guaranteed Refund

The Guaranteed Refund is a separate mechanism from the month-of-death check. Every TSERS retirement option includes it as an automatic safety net.

Here is how it works: at retirement, the member had a balance of accumulated contributions plus interest. If the total monthly pension payments received by the retiree (and by the monthly survivor beneficiary, if applicable) do not exhaust that balance before everyone entitled to monthly payments dies, the remaining balance is paid as a lump sum.

The lump sum goes to the person named on Form 336 — the Guaranteed Refund beneficiary. This person cannot be the same individual as the monthly survivor beneficiary. If no Form 336 designation exists, the balance follows the statutory default: surviving spouse first, then the estate.

Whether any Guaranteed Refund remains depends on the total pension payments compared with the contributions and interest balance at retirement. RSD can confirm whether a balance remains.

Timeline After Reporting

Once you report the death and any overpayment issues are resolved, expect the following processing timeline:

  • Retiree death claims: 30 to 60 days from the receipt of the certified death certificate and all required forms
  • Active member death claims: 60 to 90 days, because the employer must first certify the work record on Form 253
  • Survivor pension first payment: retroactive to the first day of the month following the death
