NC TSERS Death During Retirement Application: Which Benefits Apply When a Member Dies Before the First Check

A TSERS member submits their retirement application in November, selects Option 2 with their spouse as the monthly survivor beneficiary, and sets a January 1 retirement date. Then they die in December — before the first pension check ever arrives. Does the spouse get the Option 2 survivor pension? Or does RSD treat this as an active member death?

The answer depends entirely on whether Form 6 and Form 6E were properly received by the Retirement Systems Division before the date of death.

When the Application Was Filed and Received

If the member completed and submitted Form 6 (Applying for Monthly Retirement Benefit) and Form 6E (Choosing Your Retirement Payment Option), and RSD received both signed forms before the death occurred, the retirement election is legally binding. RSD processes the claim as though the member survived to the effective retirement date.

This means:

  • The payment option is honored — if the member selected Option 2 (100% Joint and Survivor), the named monthly survivor beneficiary receives the full survivor pension for life
  • Retroactive payments begin from the first day of the month following the effective retirement date
  • The member is treated as a retiree for all benefit purposes, not as an active employee

This distinction matters enormously for the family. Under Option 2, the spouse receives a lifetime monthly pension. Under active member death rules, the spouse might receive only a lump-sum Return of Contributions (if the member did not qualify for the Survivor's Alternate Benefit) or an SAB calculated differently than the Option 2 they thought they had.

When the Application Was Not Filed

If the member died before RSD received the signed Form 6 and Form 6E — whether the forms were never completed, were still sitting on the kitchen table, or were mailed but not yet received and logged — the retirement application is void. RSD processes the death strictly under active member death rules.

Under active member death rules, the family's benefits are determined by the member's service at the time of death and the beneficiary designation on Form 2C, not the retirement option the member intended to select:

Why the Timing Creates Confusion

The gap between filing a retirement application and receiving the first check can span several months. Members often file Form 6 months in advance of their chosen retirement date. During that window, their status is ambiguous from the family's perspective — the member considers themselves "retired" or "about to retire," but legally they remain an active member until the retirement date arrives and benefits begin.

Families sometimes assume the retirement election is automatic once the member planned to retire or told HR they were retiring. It is not. RSD's record showing receipt of both signed forms before death determines whether the retirement election takes effect.

What Survivors Should Do

If a TSERS member dies with a pending retirement application:

  1. Report the death to RSD immediately at (919) 814-4590 or through MyNCRetirement.com
  2. Ask RSD to confirm whether Form 6 and Form 6E were received and logged before the date of death
  3. Do not assume the retirement option applies until RSD confirms it in writing

If the forms were received, the spouse or designated survivor beneficiary should receive the claim packet reflecting the retirement option. If the forms were not received, the claim will be processed under active member rules, and the family should review whether the Survivor's Alternate Benefit applies based on the Form 2C beneficiary designation.
