CalSTRS Pension Overpayment After Death: Bank Clawbacks and How to Prepare
How Overpayments Happen
CalSTRS pension payments are issued monthly via direct deposit. If a retiree dies mid-month, the payment for that partial month is prorated — the surviving beneficiary is entitled to the portion covering the days the retiree was alive. Any payment deposited after the month of death is legally unearned.
Because direct deposits are automated, it's common for at least one full payment to land in the bank account after the retiree has died. If the death isn't reported to CalSTRS promptly, multiple payments can accumulate.
The ACH Recall Process
CalSTRS recovers overpayments through the State Controller's Office via automated ACH recall. This is an electronic reversal that pulls funds directly back from the bank account — typically the same joint checking or savings account where the pension was deposited.
An ACH recall can remove the overpayment from the deposit account. If the surviving spouse has already spent those funds — paying funeral expenses, medical bills, or household costs from the joint account — the recall can overdraft the account.
How to Protect the Account
Report the death immediately. The sooner CalSTRS knows, the fewer payments get issued post-death. Report online at CalSTRS.com or call 800-228-5453.
Contact the bank. Tell the bank that the account holder has died and that a pension direct deposit may be recalled. Some banks can flag the account or set aside funds equal to one month's pension payment to cover the expected recall.
Don't spend post-death deposits. If a pension payment arrives after the death, treat it as funds that will be recalled. Don't use it for expenses — set it aside in a separate account or leave it untouched.
Consider separating the joint account. If the pension went to a joint account that the surviving spouse needs for daily expenses, work with the bank to separate the survivor's funds from the pension overpayment amount.

What If the Bank Can't Recover the Full Amount
If the financial institution cannot reverse the full overpaid amount through ACH, CalSTRS issues a demand letter to the estate. If the demand goes unpaid, CalSTRS can offset the debt against the one-time death benefit or ongoing monthly option allowances payable to surviving beneficiaries.
In other words, the overpayment doesn't disappear — CalSTRS will recover it one way or another. Proactive management is always less painful than an offset against the survivor's monthly benefit.
