CalPERS Death Benefit Overpayment: Direct Deposit Recalls and What to Expect

One of the most unsettling things that happens after a CalPERS retiree dies is the overpayment recall. CalPERS stops pension payments as of the date of death, and any part of a payment covering a period after that date — even if it landed in a joint bank account you depend on — is considered an overpayment that CalPERS is required by statute to recover. A prorated allowance for the days the retiree was alive may still be payable.

This isn't optional or negotiable. The recovery process happens whether you knew about it or not, and it can create a sudden cash crunch for a surviving spouse who was counting on that month's pension to pay the mortgage.

How the Recall Process Works

When CalPERS receives notification of a retiree's death, they immediately stop future monthly allowance payments. Then they contact the retiree's financial institution to recall any direct deposits transmitted for periods after the date of death.

If a retiree died on the 10th of the month but the full month's direct deposit had already been transmitted, CalPERS calculates a prorated allowance for the 10 days the retiree was alive and recalls the remainder. The bank debits the recalled amount from the account, sometimes without warning to the account holder.

If the retiree received physical warrant checks (paper checks), any uncashed warrants issued for periods after the date of death must be returned directly to CalPERS's Disability and Survivor Benefits Division.

What Happens to the Money in Your Account

If the post-death deposit was made to a joint account and some of those funds were spent, CalPERS says it requests reimbursement from the financial institution for electronic transfers into the deceased's account. If the recall does not return the full amount, contact CalPERS to confirm whether a balance remains and how to resolve it.

The best practice when a retiree dies is to immediately preserve any pension deposits received after the date of death. Don't spend them. Don't transfer them. Keep the funds available so the bank can process the recall cleanly without overdrafting the account.

If the financial institution returns the full amount, retain its confirmation. If the recall does not return the full amount — for example, because the account was closed or lacked sufficient funds — contact CalPERS to ask whether a balance remains and what steps are required.

The Prorated Payment You Are Owed

CalPERS doesn't take everything. They calculate a prorated monthly allowance for the days in the month of death that the retiree was alive. This prorated payment is distributed to the designated prorated allowance beneficiary or, if none was named, to the statutory beneficiary under California Government Code § 21493.

So if a retiree died on March 15, you'd be owed 15/31 of the monthly allowance for March. That prorated amount, minus the recalled overpayment, determines whether you receive additional money or owe CalPERS.

Report the death to CalPERS as quickly as possible. Every day between the death and CalPERS's stop-payment action is another day where automatic deposits may go out and need to be recalled later. Call 888-225-7377 or report online through the myCalPERS portal.

If you're a surviving spouse who depended on the pension income for household expenses, the gap between the overpayment recall and the start of your own survivor benefit payments can be financially stressful. CalPERS targets a 45-day processing window from when they receive your complete application, but that clock starts only after all required documents are submitted.

Having your certified death certificate, marriage certificate, and application forms ready to submit immediately after reporting the death minimizes this gap.
