What a Retired Annuitant Actually Is
A retired annuitant is a CalPERS retiree who returns to work for a CalPERS-covered employer without formally reinstating from retirement. You keep collecting your pension while working part-time or on a limited basis. The arrangement sounds straightforward, but it is governed by strict statutory limits designed to prevent pension spiking and ensure retired members do not simply retire and return to the same job at full capacity.
Violating these rules can put your pension at risk, including suspension. Confirm the limits before accepting a retired annuitant appointment.
The 960-Hour Annual Cap
The most fundamental rule: a retired annuitant cannot work more than 960 hours in a fiscal year (July 1 through June 30). If you have more than one appointment, confirm with CalPERS how hours are counted across employers.
At roughly 20 hours per week for 48 weeks, the 960-hour cap functions as a half-time limit.
There is no provision to carry unused hours into the next fiscal year. Each July 1, the clock resets to zero.
The 180-Day Wait Period
You cannot begin working as a retired annuitant until 180 calendar days after your retirement date. This break-in-service requirement exists to prevent retire-and-rehire arrangements where an employee retires on a Friday and returns to the same desk on Monday.
The 180-day rule applies to all CalPERS-covered employment, not just the employer you retired from. If you retired from the State of California on March 1, you cannot start a retired annuitant appointment at any CalPERS-covered city, county, or school district until August 28.
Exceptions to the 180-Day Wait
Statutory exceptions can allow an appointment before 180 days in limited cases. Confirm the applicable conditions and approval steps with CalPERS and the employer before starting work.

Pay and Benefit Restrictions
Retired annuitants cannot earn a pension on the work they perform after retirement. The appointment does not generate additional service credit or retirement benefits.
Your pay rate must not exceed the rate paid to other employees performing comparable duties.

Track your own hours and confirm with the appointing employer how retired annuitant hours are reported to CalPERS.

What Happens If You Exceed 960 Hours
Exceeding 960 hours can put your pension at risk, including suspension. Track your hours carefully and contact CalPERS if you discover that you have exceeded the limit.
Common Situations
Substitute teaching. School districts frequently hire retired CalPERS members as substitute teachers or classified substitutes. Every substitute day counts toward the 960 cap, so a retiree who works as a daily sub for a full school year can hit the limit by March.
Emergency appointments. Employers sometimes bring back retirees for emergency staffing — natural disasters, budget crises, or unexpected vacancies. The 180-day waiver process exists for these scenarios, but the 960-hour cap still applies regardless of the emergency.
Multiple part-time appointments. A retired city planner who consults for two different cities and teaches a community college course is accumulating hours toward the same 960 across all three employers.
Private Sector Work Has No Cap
The 960-hour rule and 180-day wait period apply exclusively to employment with CalPERS-covered public employers. If you retire from CalPERS and take a private-sector job — consulting, retail, freelancing, or any non-public employer — there are no hour limits, no waiting period, and no impact on your pension.
