CalPERS Lump Sum Death Benefit: Amounts, Eligibility, and How to Claim
Two Different Lump-Sum Benefits
CalPERS has two distinct lump-sum death benefits, and they apply to different situations. Confusing them is common — the amounts and eligibility rules are entirely different.
Basic Death Benefit (Active Members)
The Basic Death Benefit is for beneficiaries of members who die before retirement. It has two parts:
Accumulated contributions plus interest. Every dollar the member contributed to CalPERS during their working career, plus compound interest through the date of death. For a member with 20 years of state service, this can be $80,000 to $150,000 or more depending on salary and contribution rates.
Employer supplement. If the member was actively employed or died within 120 days of separating, CalPERS adds an employer-funded payment equal to six months of salary (50% of annual earnings for the prior 12 months). A member earning $90,000 per year gets a $45,000 employer supplement.
The Basic Death Benefit is a true lump sum — one payment, no ongoing monthly installments.
Critical trade-off: If the active member was eligible for service retirement at death, the surviving spouse or partner must choose between the Basic Death Benefit lump sum and a monthly allowance (Pre-Retirement Option 2W or the 1957 Survivor Benefit). Choosing the lump sum permanently ends eligibility for CalPERS health coverage. This is irreversible.
Lump Sum Retired Death Benefit (Retired Members)
When a retired CalPERS member dies, their designated beneficiary or statutory survivor receives the Lump Sum Retired Death Benefit. This is a flat, contracted amount — far smaller than the Basic Death Benefit.
The specific amount depends on the employer's contract with CalPERS:
- $500
- $600
- $2,000
- $3,000
- $4,000
- $5,000
If the retiree accumulated service credit with multiple CalPERS employers, CalPERS pays the single highest contracted amount among those employers — not the sum.
Senate Bill 1168 raised the minimum for local agencies that contract for the death benefit to $2,000, replacing the old $500 floor for new contracts. However, some legacy contracts still carry $500 or $600.

The "$500 Burial Benefit" Misconception
Many people search for a CalPERS "$500 burial benefit" or "funeral benefit." There is no separate CalPERS burial or funeral benefit. The $500 figure comes from the minimum Lump Sum Retired Death Benefit under older employer contracts. It's not earmarked for funeral expenses — it goes to the designated beneficiary for any purpose.
The amount is small enough that families are often surprised by it, especially after the retiree had been receiving a substantial monthly pension. The Lump Sum Retired Death Benefit was never designed to cover funeral costs — it's a legacy benefit that some employers have increased through contract amendments over the years.
How Lump Sums Are Taxed
Taxable lump-sum distributions paid directly to a beneficiary in cash are subject to 20% mandatory federal income tax withholding. A surviving spouse can avoid the withholding with a direct rollover. A non-spouse beneficiary may use a direct trustee-to-trustee transfer to an inherited IRA; a cash payment cannot later be rolled over, and the inherited IRA is subject to the SECURE Act's 10-year distribution rules.
CalPERS reports taxable death benefit distributions annually on Form 1099-R.

Both benefits are claimed through the standard survivor application process — report the death to CalPERS (888-225-7377 or myCalPERS), receive the customized application package, and submit it with all certified documents.
