CalPERS Beneficiary Documents Needed for a Death Claim
Certified Documents
CalPERS requires certified supporting documents, such as certified copies of vital records. Request official copies from the issuing agency and check for its certification seal or stamp. Plan to spend time and money ordering these, especially if records come from multiple states or decades past.
The Death Certificate
CalPERS requires a certified death certificate that states both the cause and the manner of death. A certificate missing either detail can delay the claim.
This can affect families in cases involving coroner investigations — homicides, accidents, or unexplained deaths — where the final cause or manner may not be determined immediately. Ask the issuing agency how to obtain an amended certificate once the investigation is complete.
Request multiple certified copies from the county vital statistics office. CalPERS needs one, and you may need others for Social Security, life insurance, banks, and other agencies.
Proof of Relationship
For a surviving spouse: A certified copy of the marriage certificate. If married outside California, order it from the state or country where the ceremony took place.
For a registered domestic partner: The California Secretary of State's domestic partnership registration.
For minor or dependent children: Certified birth certificates for each child who may be eligible for benefits, including unmarried children under 22 for the 1959 Survivor Benefit and Special Death Benefit.

Prior Marriage Records — All of Them
This is the document that delays more claims than any other. CalPERS requires certified dissolution decrees for every prior marriage and domestic partnership of the deceased member and the surviving spouse. Not just the most recent — every single one.
If the deceased member was married in 1985, divorced in 1990, remarried in 1995, and that second spouse is now filing the claim, CalPERS needs the 1990 divorce decree. If the surviving spouse was previously married and divorced before marrying the member, CalPERS needs that divorce decree too.
Why? CalPERS must verify that no former spouse has community property rights to the pension. California is a community property state, and pension benefits earned during a marriage are marital assets. A former spouse with a Domestic Relations Order (DRO) may be entitled to a portion of the survivor benefits.
Tracking down a 30-year-old divorce decree from another state requires contacting that state's court clerk, paying fees, and waiting for processing. Start this as soon as you know it's needed.
The Full Family Disclosure
The application form requires a complete list of all surviving family members — not just those expecting to receive benefits. This means:
- Current spouse or registered domestic partner
- All former spouses and former domestic partners (living or deceased)
- All children (including from prior relationships and adopted children)
- Parents
- Siblings
CalPERS uses this to verify the statutory beneficiary hierarchy under California Government Code Section 21493. Omitting anyone — even a sibling you haven't spoken to in years — triggers a follow-up request that delays processing.
Community Property and DRO Documents
If the member was previously divorced and a Domestic Relations Order (DRO) or judgment of dissolution divided the CalPERS benefit, CalPERS needs a certified copy of that order. A former spouse with a valid community property claim may receive a share of survivor benefits, and CalPERS will not distribute payments until the claim is resolved.
