CalPERS Active Employee Death Benefits: What a Spouse Receives

Benefits Available When an Active Member Dies

When a CalPERS member dies before retirement, the surviving family may be entitled to multiple benefits simultaneously. The six-month salary supplement to the Basic Death Benefit applies if the member died while actively employed or within 120 days of separation. Which benefits apply depends on the member's service credit, age at death, membership tier, and the employer's contract with CalPERS.

Basic Death Benefit (Every Active Member)

Every active CalPERS member's beneficiary receives the Basic Death Benefit, regardless of age or years of service. It's a lump sum with two components:

Member contributions plus interest. Everything the member paid into CalPERS during their career, plus accumulated interest through the date of death.

Employer-funded supplement. If the member was still on active payroll at death (or died within 120 days of separation), CalPERS adds an employer-funded payment equal to six months of the member's salary — calculated as 50% of annual earnings for the 12 months before death.

For a member earning $80,000 per year with $60,000 in accumulated contributions, the Basic Death Benefit would be roughly $100,000 ($60,000 contributions + $40,000 employer supplement).

Pre-Retirement Option 2W (Eligible Members Only)

If the active member had enough service to have retired — age 50 with 5 years of service for Classic members, age 52 with 5 years for PEPRA Miscellaneous — the surviving spouse or registered domestic partner can choose Option 2W instead of the Basic Death Benefit lump sum.

Option 2W pays a monthly allowance for the spouse's lifetime equal to what the spouse would have received had the member retired on the date of death and chosen Option 2W. For a member with 25 years of service, this typically produces a larger lifetime value than the lump sum — plus it preserves CalPERS health insurance eligibility, which the lump sum does not.

1957 Survivor Benefit

An alternative to Option 2W for eligible members' survivors: a monthly allowance equal to 50% of the Unmodified Allowance the member would have received in retirement. Same eligibility requirements as Option 2W. The spouse must choose between the 1957 Survivor Benefit and Option 2W — they can't receive both, and Option 2W is almost always the higher payment.

Group Term Life Insurance

Active CalPERS state employees typically receive $5,000 in employer-paid group term life insurance. The named beneficiary files a separate claim for this — it's administered alongside CalPERS benefits but is a distinct payout.

1959 Survivor Benefit

For members whose position was not covered by Social Security, the employer may have contracted for the 1959 Survivor Benefit Program. It's paid in addition to the Basic Death Benefit. If the family also qualifies for the Special Death Benefit, CalPERS pays that benefit plus any amount by which the 1959 Survivor Benefit exceeds it. The amount depends on the contracted level — for Level 5 (mandatory for State and School), it's $750/month for one survivor in 2026.

Special Death Benefit (Safety Members)

If an active Safety member — law enforcement, fire, corrections — dies from an industrial cause, the Special Death Benefit pays 50% of final monthly compensation. If the death resulted from a violent act or external force while on duty, the allowance may increase to as much as 75%, depending on the number of dependent children. This is entirely tax-exempt and represents one of the most substantial CalPERS death benefits.

The Employer's Role

For active state employees, the employing department automatically continues health, dental, and vision coverage for covered dependents for 120 days. The family should still report the death to CalPERS directly (888-225-7377) to start the formal survivor benefit application.
