VRS Return to Work Rules: Working After Retirement

Plenty of VRS retirees want to keep working — some for the income, some because they are not ready to stop. The rules on working after retirement are straightforward for private-sector employment but carry specific restrictions if you want to work for a VRS-participating employer.

The Mandatory One-Month Break in Service

Before you can do anything else, you must complete a bona fide break in service of at least one full calendar month over a period you would normally work. This means complete separation from covered and non-covered employment with a VRS-participating employer. Non-covered part-time work, volunteer work, or independent contracting with the same employer during the break invalidates it.

"Full calendar month" means an entire month from the first day through the last. If your effective retirement date is July 1, your break-in-service period runs through all of July, and you cannot return to VRS-covered employment until August 1 at the earliest.

The break must fall during a period you would normally work. For teachers and other 10-month employees, summer break does not satisfy this requirement because it is not time you would normally be working. A teacher retiring at the end of the school year in June needs to remain separated through an entire month of the next school year to complete a valid break.

Failing this requirement voids your retirement application entirely. VRS does not simply dock your pension or impose a penalty — your retirement is treated as though it never happened.

Working for Non-VRS Employers

Once your break in service is complete, you can work for any private-sector employer, non-participating public employer, or self-employment without affecting your VRS monthly pension. There are no earnings limits or restrictions on private-sector work for VRS retirees.

Returning to a VRS-Participating Employer

This is where the rules get tighter. If you return to work with a VRS-participating employer (any state agency, public school division, or political subdivision that participates in VRS), your pension payments may be affected depending on the type and duration of employment.

Whether pension payments continue when you return to a VRS-participating employer depends on the applicable reemployment rules and any exception that applies. Confirm the treatment of the exact position with VRS and employer HR before accepting. If you retire again after returning to covered employment, VRS requires you to use the same payout option you chose originally.

Part-time or temporary work can also be subject to position-specific rules. Contact VRS directly to verify how a specific position would affect your benefits before accepting any offer.

Critical Shortage Exceptions

Virginia law provides exceptions for certain retired workers returning to designated "critical shortage" positions. Eligible categories include retired teachers and specialized school personnel, as well as retired law enforcement officers returning under designated critical-shortage provisions.

Under these provisions, eligible retirees can receive their full monthly VRS pension while working in a covered position — provided they have completed the mandatory break-in-service requirement and all administrative reporting criteria are met.

These exceptions apply to designated critical-shortage positions. Confirm whether the specific position qualifies and what reporting requirements apply.

Plan Before You Accept a Post-Retirement Job

If you are considering returning to work after retirement, determine whether the employer participates in VRS before accepting any position. A private-sector or federal job has no impact on your VRS pension. A job with a VRS-participating employer can suspend or alter your benefits in ways that are difficult to reverse.
