Why the Bank Account Suddenly Freezes
TRS issues monthly annuity payments on the last business day of each month. Under Texas Government Code § 824.002, an annuity is payable for the full month in which the retiree dies. That payment belongs to the retiree's estate or account.
But any payment issued for the month after death — or any subsequent month — is an unauthorized overpayment. TRS will recover it, usually by initiating an electronic fund transfer (EFT) reversal directly through the banking system.
When a bank receives a reversal request, it may freeze the entire account or pull the payment amount without warning. For surviving spouses who share a joint bank account with the retiree, this creates sudden financial distress: money they assumed was available disappears, sometimes just when funeral expenses and household bills are due.
How to Prevent the Problem
Report the death to TRS as quickly as possible — ideally within the first three days. Call 1-800-223-8778 and tell TRS to freeze the annuity direct deposit. If TRS stops the payment before it is issued, no overpayment occurs and no reversal is necessary.
The timing matters because of how monthly payments work:
- Retiree dies on March 12. The March payment (issued at the end of March) is legitimate — it covers the month of death. No overpayment.
- Retiree dies on March 12, death not reported until April 15. The March payment is legitimate. The April payment (issued at the end of April) is an overpayment. TRS initiates a reversal.
- Retiree dies on March 12, death not reported until May. Both April and May payments are overpayments. TRS reclaims both.
The longer the gap between the death and the notification, the more months of overpayment accumulate and the larger the reversal.
What Happens If the Money Was Already Spent
If the overpaid amount is no longer in the bank account — because bills were paid, cash was withdrawn, or the account balance dropped — the bank may not be able to complete the electronic reversal. In that case, TRS may issue a collection demand to the financial institution or the estate.
If a reversal does not recover the amount, contact TRS for repayment instructions before assuming how the overpayment will affect any continuing survivor benefit.

Practical Steps for the Surviving Spouse
- Call TRS at 1-800-223-8778 immediately. Do this the same day or the next day — do not wait for a convenient time or for other family members to arrive.
- Do not spend the payment that arrives after death. If a deposit lands in the joint account after the death, set it aside. It will almost certainly be reversed.
- Move essential funds. If you share a joint account with the deceased, consider opening a separate personal account and transferring enough money to cover immediate expenses. This protects your access to funds if the bank freezes the joint account during the reversal process.
- Keep records of every transaction. If TRS initiates a reversal and the bank pulls more than the overpaid amount (rare but documented), you need a paper trail to dispute the error.
- Contact the bank. Let them know a pension reversal may be incoming. Some banks can flag the specific payment for reversal without freezing the entire account.
The Month-of-Death Payment Is Not an Overpayment
One important distinction: the annuity payment for the month in which the retiree died is not an overpayment under Texas Government Code § 824.002. It belongs to the retiree's estate or account. If TRS or the bank mistakenly reverses it, the estate representative should document the date of death and payment date, then contact TRS to have the matter corrected.
