TRS Illinois Return to Work After Retirement — 120-Day Rule and 2027 Changes

The Basic Limit: 120 Days or 600 Hours

After you retire from TRS, you can return to a TRS-covered teaching position without losing your pension — but only within strict limits. The current cap is 120 days or 600 hours per school year, whichever comes first.

This limit has been extended by the legislature multiple times. The most recent extension runs through June 30, 2029. Under current law, it returns to 100 days or 500 hours on July 1, 2029.

A separate Return to Teaching in a Subject Shortage Area program exempts approved retirees from the 120-day/600-hour limit through June 30, 2027. A regional superintendent must designate the shortage area and TRS must approve the hire; the program has separate eligibility and waiting-period rules.

The cap applies across all TRS-covered employers, not per district. If you teach 80 days at one district and 50 days at another in the same school year, you've hit 130 days and exceeded the limit.

The Mandatory 30-Day Break

Before you can do any post-retirement teaching, you must observe a 30-calendar-day break from the employer you last worked for before retiring. During those 30 days, you cannot perform any paid duties requiring teacher licensure at that employer's schools.

The 30-day rule applies only to your last pre-retirement employer, but the separate same-school-year rule still bars TRS-covered teaching during the school year in which you retired.

The 2027 Separation Rule

For retirement dates effective on or after January 1, 2027, TRS requires members to completely separate from all roles with their last employer — not just TRS-covered positions. Members must terminate employment in all capacities, have no prearranged re-employment with that employer, and remain separated for at least 30 days after their termination date.

That means coaching, club sponsoring, bus driving, tutoring, or any other paid position at the same employer. If you're planning to retire as a teacher but keep coaching at the same school, the 2027 rule requires a full 30-day break from every role before the pension starts.

This catches people who assumed they could retire from their teaching contract but immediately continue coaching under a separate agreement with the same district.

What You Cannot Do

Two absolute prohibitions apply regardless of the day or hour count:

  1. No prearranged return-to-work agreements. Under current rules, you cannot prearrange post-retirement work requiring teacher licensure with the same employer before 30 days after retirement. For retirement dates effective on or after January 1, 2027, you also cannot prearrange re-employment with your last employer before termination.

  2. No teaching in the same school year you retired. If you retire effective June 30, you cannot teach in a TRS-covered position during the same school year (which typically ends June 30). Your return-to-work eligibility starts with the next school year.

What Happens If You Exceed the Limit

If you exceed the limit, TRS suspends your annuity and you re-enter active membership. Your employer must remit TRS contributions on creditable earnings after the limit is exceeded, and retiree health insurance may be affected. If you resume teaching in the same school year you retired or exceed the limit during your first school year after retirement, you must repay all annuity payments from your retirement date.

Your employer must report your days and hours to TRS and remit contributions on creditable earnings after the limit is exceeded.
