NYSTRS and the WEP Repeal: What the Social Security Fairness Act Means for New York Teachers
The Federal Repeal in Brief
The Social Security Fairness Act (H.R. 82), signed into law on January 5, 2025, repealed two provisions that had reduced Social Security benefits for millions of public employees since the 1980s:
- Windfall Elimination Provision (WEP): reduced Social Security retirement benefits for workers who also earned a pension from non-covered government employment
- Government Pension Offset (GPO): reduced or eliminated Social Security spousal and survivor benefits for recipients of non-covered government pensions
Both are now gone, retroactive to January 2024. The Social Security Administration completed implementation and paid retroactive adjustments in early 2025.
Why Most NYSTRS Members Were Not Directly Affected by WEP
Here's the part that confuses people: NYSTRS members pay Social Security (FICA) taxes during their public school employment. Their teaching positions are "covered" employment under Social Security. WEP targeted workers with pensions from "non-covered" employment — jobs where Social Security taxes were not withheld.
Because NYSTRS members pay into Social Security, WEP did not reduce the Social Security benefits earned from their New York teaching career. The offset never applied to their primary covered employment.
Who Among NYSTRS Members Does Benefit
Two specific groups of NYSTRS members gained from the repeal:
Members with non-covered service in other states. If you taught in Texas, Ohio, or another state where public employees did not pay into Social Security, and you also have a Social Security earnings record from New York teaching, WEP previously reduced your Social Security benefit. That reduction is now eliminated.
Members claiming spousal or survivor Social Security benefits. If you received a pension from non-covered employment, GPO could reduce or eliminate the Social Security spousal or survivor benefit you qualified for based on another worker's record. That offset is gone.
If you were previously denied a spousal or survivor benefit because of GPO, you need to file a new claim with the Social Security Administration. The adjustment for those who never applied is not automatic — you must initiate it.

What the Repeal Does Not Change
The federal repeal did not touch the Tier 3 Article 14 Social Security offset. This is a New York State plan-level provision, entirely separate from the federal WEP and GPO.
Under Article 14, Tier 3 members who retire under those rules face a permanent reduction to their NYSTRS pension at age 62 — equal to 50% of the Social Security benefit earned during New York State public service. This offset is written into New York law and was not addressed by H.R. 82.
Virtually all Tier 3 members avoid this offset by electing to retire under Tier 4 (Article 15) provisions instead, which eliminates the state-level offset entirely. If you're Tier 3 and approaching retirement, make sure your benefit estimate shows both Article 14 and Article 15 projections.
What You Should Do Now
If you were affected by WEP or GPO:
- Check that the Social Security Administration has already applied the automatic adjustment to your benefits back to January 2024
- If you never applied for spousal or survivor benefits because GPO would have eliminated them, file a new claim with SSA
- If you receive a retroactive lump-sum adjustment, consult a tax professional about the federal income tax implications
If you were not affected (most NYSTRS members): the repeal is good news for the broader public employee retirement landscape, but it doesn't change your NYSTRS pension calculation or your Social Security benefit earned from covered New York teaching service.
