NYSTRS Tier 4 Retirement: The 30 and 55 Rule, Article 15, and Pension Factors

The 30 and 55 Rule

Tier 4 covers NYSTRS members who joined between September 1, 1983, and December 31, 2009 — the largest cohort of educators currently approaching retirement. The headline eligibility rule is straightforward: if you have 30 or more years of credited service, you can retire at age 55 with your full unreduced benefit.

Without 30 years of service, you need to wait until age 62 for an unreduced pension. Retiring between 55 and 62 with fewer than 30 years triggers permanent lifetime reductions:

  • 5% per year for each year between ages 60 and 62
  • 6% per year for each year between ages 55 and 60

A Tier 4 member retiring at 55 with 25 years of service would face a 27% permanent reduction — the maximum penalty. That reduction applies to every monthly check for the rest of your life.

Article 15 Pension Factors

Tier 4 members retire under Article 15 of the Education Law, which sets a tiered pension factor schedule:

  • 1.67% per year for the first 20 years of service
  • 2.0% per year for years 20 through 30
  • 1.5% per year for service beyond 30 years

This means a 30-year career earns a pension factor of 53.4% of your FAS. A 35-year career reaches 60.9%. The diminishing return past 30 years is why many Tier 4 educators target exactly 30 years as their exit point.

How FAS Is Calculated

Tier 4 uses the highest three consecutive school years (July 1 to June 30) of reportable salary for the Final Average Salary. There's one critical constraint: no year in the FAS window can exceed the average of the prior two years by more than 10%. Salary above that 10% cap is excluded.

If your three highest years were $92,000, $96,000, and $105,000, you'd calculate whether the $105,000 exceeds the average of the prior two ($94,000) by more than 10%. The cap is $103,400, so $1,600 of the final year would be excluded. Your FAS would be ($92,000 + $96,000 + $103,400) / 3 = $97,133 instead of $97,667.

Non-regular compensation — termination bonuses, unused sick-leave lump sums, and extra-duty payments outside your contract — are excluded entirely.

Contributions

Tier 4 contribution rules are separate from these pension factors. Confirm the contribution rate and any required contribution period for your membership and service history with NYSTRS.

Tier 3 Members Electing Article 15

Tier 3 members (July 27, 1976 – August 31, 1983) have a specific reason to pay attention to Tier 4 rules. Tier 3 falls under Article 14, which includes a state-level Social Security offset — at age 62, your NYSTRS pension is reduced by 50% of the Social Security benefit you earned during New York public service. This offset is separate from the now-repealed federal WEP/GPO and remains active law.

To avoid this offset, virtually all Tier 3 members elect to retire under Tier 4 (Article 15) rules, which New York law permits. The Article 15 pension factor and FAS rules then apply instead.
