When Probate Is Not Required for an NYSLRS Death Benefit
Most NYSLRS death benefits bypass probate entirely. When a living beneficiary is on file, the benefit is generally paid directly to that person. A certified DRO on file that requires a former spouse to be named for the benefit can supersede a later beneficiary form; a will generally does not replace the NYSLRS beneficiary record.
Probate becomes relevant when the benefit must be paid to the deceased's estate rather than directly to a named individual. This can happen when no eligible beneficiary remains or the designation directs payment to the estate.
When the estate is the recipient and the claim qualifies, New York law provides a small-estate affidavit route under Section 1310.4 of the Surrogate's Court Procedure Act (SCPA).
How SCPA 1310.4 Works with NYSLRS
SCPA 1310.4 provides a small-estate affidavit route for collecting qualifying assets owed to an estate without opening a full probate proceeding. The filer submits an affidavit to establish the right to collect the funds on behalf of the estate.
NYSLRS uses Form RS4139, Affidavit for Benefit Payment, to collect qualifying pension benefits that would otherwise require estate proceedings.
Eligibility depends on the statute and the current form instructions; confirm that the estate and benefit qualify before relying on this process.
Filing Form RS4139 Step by Step
Report the death and ask NYSLRS about the estate claim. NYSLRS issues customized claim forms after processing the death report and certified death certificate. Ask for the current RS4139 instructions and filing requirements.
Confirm the pension benefit is payable to the estate. Contact NYSLRS Survivor Services at 1-866-805-0990 and ask what documentation is needed to establish that the benefit is payable to the estate. NYSLRS does not disclose beneficiary details over the phone for privacy reasons; the claim packet provides the next steps after the certified death certificate is processed.
Verify the estate qualifies. Use the current Form RS4139 and SCPA 1310.4 criteria; do not assume that the NYSLRS benefit amount alone determines eligibility.
Complete Form RS4139. Follow the current form instructions for the required information, supporting documents, and signature or oath requirements.
Submit to NYSLRS along with a certified death certificate bearing a raised seal. Mail to NYSLRS, Attn: Survivor Services, 110 State Street, Albany, NY 12244.

What the Affidavit Does Not Cover
The small estate affidavit covers only the lump-sum payment owed to the estate. If the deceased retiree's option continuance (a monthly survivor pension) is payable, it goes to the named option beneficiary directly — not through the estate. The affidavit is typically used for the post-retirement death benefit, accumulated member contributions, or a final partial-month pension payment that falls to the estate because no beneficiary is on file.
It does not settle ownership or probate for real property, bank accounts held solely in the decedent's name at other institutions, or other non-NYSLRS assets. Ask the relevant institution, Surrogate's Court, or an attorney what process applies to those assets.
When Court Letters May Be Required
If the estate or claim does not meet SCPA 1310.4 and Form RS4139 criteria, NYSLRS may require letters testamentary or letters of administration before releasing a benefit payable to the estate.
This process adds weeks to months to the claim timeline. It is one of the strongest reasons to keep NYSLRS beneficiary designations current — a named living beneficiary avoids all of this.
