NYSLRS Survivor Benefits Documents Checklist: What You Need to File a Death Claim
The Documents NYSLRS Requires for a Death Benefit Claim
Collecting the right paperwork before you file saves weeks. NYSLRS cannot process a death benefit claim until specific documents arrive in Albany, and missing or incorrect documents trigger back-and-forth that delays payment. Here is what you need, organized by when you'll need it.
Documents to Gather Immediately (Days 1–7)
Certified death certificate with a raised seal. This is the single most important document. NYSLRS requires an original certified copy — not a photocopy, not a funeral home courtesy copy, not a printout from a vital records website. The certificate must bear the raised seal of the issuing registrar. Order multiple certified copies from the funeral director or the local registrar of vital statistics, and ask each agency whether it needs an original.
The deceased's NYSLRS identification. You need the registration number (for active members) or retirement number (for retirees). Find this on any correspondence from NYSLRS, the Member Annual Statement, the Retiree Annual Statement (mailed each February), or the Retirement Online portal login. If you cannot locate the number, NYSLRS can look it up by Social Security number.
The deceased's Social Security number. Have it available; NYSLRS may request it when identifying the member or completing claim paperwork.
Documents for the Claim Packet (Days 7–30)
After NYSLRS receives the death certificate, Survivor Services mails a personalized claim packet to each named beneficiary. The packet contains the specific forms for that beneficiary's situation, but you should have these supporting documents ready:
Marriage certificate — required if you are claiming as a surviving spouse. NYSLRS needs proof of marriage to process a Joint Allowance continuance, the 50% COLA provision, and NYSHIP dependent survivor coverage. A photocopy of the marriage certificate is usually sufficient.
Birth certificate or proof of age — NYSLRS may request proof of age for Joint Allowance beneficiaries and for minor children claiming an accidental death benefit. Follow the claim packet for acceptable documents.
Guardianship papers or UTMA custodian documentation — required if any beneficiary is a minor child. NYSLRS cannot pay benefits directly to a minor.
Letters testamentary or letters of administration — may be required if the benefit is payable to the deceased's estate. If the estate and benefit meet the criteria in SCPA 1310.4, Form RS4139 (Affidavit for Benefit Payment) may be used; follow the current form instructions.
Domestic Relations Order (DRO) — if a court-ordered DRO was filed with NYSLRS during the member's lifetime, it will already be on file. If you believe a DRO exists but are unsure whether NYSLRS has it, ask Survivor Services to check.

Tax and Payment Documents (Included in the Claim Packet)
These forms come pre-printed in the NYSLRS claim packet. You fill them out and return them:
Form W-4P (Withholding Certificate for Periodic Pension Payments) — tells NYSLRS how much federal income tax to withhold from monthly survivor pension payments. If you don't submit a W-4P, NYSLRS applies default withholding based on IRS tables.
Direct deposit enrollment form (RS6370) — provides your bank routing and account number so NYSLRS deposits monthly payments electronically. Attach a voided check or a bank letter confirming the routing number.
Rollover election form — if you're receiving a lump-sum death benefit and want to roll the taxable portion into an IRA or qualified plan to defer taxes, you'll indicate the rollover on this form. You'll also need the receiving institution's name, address, and account number.
Documents You Do Not Need
A will. A will generally does not replace an NYSLRS beneficiary designation. A certified Domestic Relations Order (DRO) on file can supersede a later beneficiary form for specified benefits; the will may matter if a benefit is payable to the estate.
A "claim form" downloaded from the internet. NYSLRS does not publish a universal death benefit claim form for public download. The claim packet is customized to the deceased's specific plan, tier, option election, and beneficiary structure. You start the process by reporting the death (Form RS6082 or the online death reporting tool), and NYSLRS sends the rest.
A notarized affidavit — unless specifically requested. Some claim forms in the packet require notarization (the option beneficiary election, the small estate affidavit), but not all. The claim packet instructions indicate which forms need a notary.
How to Submit Documents to NYSLRS
Mail the original certified death certificate and any documents the claim packet directs you to submit to: NYSLRS, Attn: Survivor Services, 110 State Street, Albany, NY 12244. Use trackable delivery. If you need a replacement certificate, check the current fee with the issuing registrar.
Follow the claim packet's instructions for each document. A portal upload does not replace the required original certified death certificate.
