NJ Pension COLA: Cost of Living Adjustments for PERS and TPAF Retirees

How NJ Pension COLA Used to Work

Before 2011, New Jersey pension retirees received periodic cost of living adjustments tied to the Consumer Price Index. The Chapter 78 Suspension

The New Jersey Supreme Court upheld the COLA suspension in its 2016 ruling, finding that pension COLAs are not a constitutionally protected contractual right — unlike the base pension benefit itself, which the court has consistently held cannot be diminished. This means the Legislature can suspend or reinstate COLAs at its discretion without running afoul of the state constitution's contracts clause.

What This Means for Your Retirement Planning

The practical effect is straightforward: the pension amount you receive in your first month of retirement will remain the same nominal amount for the rest of your life, barring legislative action. Over a 20-to-30-year retirement, even modest 2–3% annual inflation erodes purchasing power substantially. A $3,000 monthly pension in 2026 buys the equivalent of roughly $1,800 in today's dollars after 20 years at 2.5% inflation.

This makes planning around the pension as a fixed — not growing — income stream essential. Members who are still accumulating service credit can partially offset the lack of COLA by:

  • Maximizing their final average salary through career advancement before retirement
  • Purchasing additional service credit to increase the pension multiplier
  • Building supplemental retirement savings through 403(b) and 457(b) plans, which provide tax-deferred growth that can supplement the flat pension in later years

Could COLA Be Reinstated?

Reinstatement requires legislative action. Several bills have been introduced over the years proposing partial or full COLA reinstatement, but none have advanced to a vote. The primary obstacle is funding: the PERS and TPAF systems carry significant unfunded liabilities, and reinstating COLA increases the systems' long-term obligations.

Advocacy organizations, including retiree associations and unions like the NJEA and its retired affiliate NJREA, continue to push for reinstatement. Any future COLA would likely be structured differently from the pre-2011 version — potentially capped at a fixed percentage or limited to retirees below certain income thresholds.

Planning Without COLA

Build your retirement budget assuming your pension payment never increases. If COLA is eventually reinstated, treat it as a windfall rather than a planning assumption. Your Social Security benefit (which does receive annual COLAs based on the CPI-W) will be the inflation-adjusted component of your retirement income.
