How to Claim FRS Survivor Benefits Without a Financial Advisor
You do not need a financial advisor to claim FRS survivor benefits. The claim is an administrative process — forms, documents, and phone calls — not a financial decision. A financial advisor can help with financial decisions, but they are not a substitute for the beneficiary or other authorized signer required by the applicable claim form. What you do need is the correct sequence. The FRS claim process involves three separate agencies, different forms depending on which plan the deceased was in, and time-sensitive steps that affect whether the bank claws back pension payments from the joint account. Here is the full sequence, in the order a family actually encounters it.
Phase 1: The First 72 Hours
Report the Death
For a Pension Plan or DROP claim, report the death to the Division of Retirement at 850-907-6500 (toll-free 844-377-1888) or through the secure portal at frs.fl.gov. Have the deceased member's Social Security number, date of death, and your contact information ready. For an Investment Plan claim, report the death to the MyFRS Financial Guidance Line at 866-446-9377 (Option 4).
If the member had benefits under both plans, contact each administrator about the benefits it handles.
If the deceased was still actively employed, call the employer's HR department to report the death. The employer handles the final paycheck, accumulated leave payout, and employer life insurance — none of which go through the Division of Retirement.
Protect the Bank Account
The retiree is entitled to the pension benefit for the calendar month in which death occurred. Any payment deposited for a later month must be returned to the Division of Retirement to avoid overpayment recovery. If a later-month deposit has landed in a joint account, the bank may debit the account without warning. If your household depends on that deposit for immediate expenses, move funds to a separate account before the return is processed.
This is the single most time-sensitive step in the entire process. Payments for months after the month of death must be returned, so contact the Division and the bank promptly if a later-month deposit lands.
Order Death Certificates
Order at least 6 certified copies. The Division of Retirement, Alight Solutions, Social Security, the employer, banks, and insurance companies each require an original. Florida vital records offices and most funeral homes provide them. Generic photocopies are not accepted.
Phase 2: Identify the Plan and Option (Days 3–14)
The entire claim path depends on two facts:
- Which plan was the deceased in? Pension Plan, Investment Plan, or both (Second Election members).
- If Pension Plan: which retirement option did the retiree choose? Options 1, 2, 3, or 4 — each pays the survivor differently.
Finding the Retirement Option
If you cannot locate the original retirement election form (Form FR-11), call the Division of Retirement. They have the option on file and will tell you over the phone once you verify your identity.
Here is what each option means for the survivor:
- Option 1 (Maximum benefit, single life): The monthly pension stops at death. The beneficiary receives only a refund of any remaining accumulated employee contributions (the 3% contributions the member paid during their career, minus any already paid out).
- Option 2 (10-year certain): If the retiree dies within 10 years of retirement, the named beneficiary receives the same monthly amount for the rest of the 10-year period. After 10 years, no further payments.
- Option 3 (100% joint and survivor): The joint annuitant — typically the spouse — receives 100% of the monthly benefit for the rest of their life. This is the most common option for married retirees.
- Option 4 (Two-thirds joint and survivor): The monthly benefit reduces to two-thirds of the original amount for the survivor.
If the retiree chose Option 3, the administrative process is straightforward: file Form FST-11b, provide documentation, and the payments resume after processing. No investment decisions, no rollover analysis, no financial advisor needed.
DROP Participants
If the deceased was in DROP (Deferred Retirement Option Program), the family files two separate claims:
- The accumulated DROP balance — claimed by the beneficiary designated on Form FST-12 (not the same as the pension beneficiary on Form BEN-001). This is a lump-sum or rollover distribution. File Form FST-11g.
- The underlying monthly pension — reverts to the Option 1–4 structure chosen at DROP entry. Claimed on Form FST-11b.
Since SB 7024 (2023), DROP participants can stay in the program for up to 96 months (or 120 months for eligible K-12 participants) at 4.0% annual interest, so DROP balances can be substantial. The lump sum is the one area where a financial advisor might add value — not for the claim itself, but for the rollover-versus-cash decision and its tax consequences.
Investment Plan Members
If the deceased was in the Investment Plan, the claim goes through Alight Solutions, not the Division of Retirement. The beneficiary designated on Form IPBEN-1 files a death benefit claim through MyFRS.com or by calling 866-446-9377.
Non-spouse beneficiaries must elect a distribution method within 1 year of the member's death. They may choose a lifetime annuity or complete liquidation within 5 years; if no method is elected within 1 year, the account defaults to liquidation within 5 years. Spousal beneficiaries have additional options, including maintaining the account.
Phase 3: Gather Documents and File (Days 14–30)
Documents Needed for Every FRS Survivor Claim
- Certified death certificate (original, not a photocopy)
- Claimant's government-issued photo ID
- Claimant's Social Security number
- Marriage certificate (if claiming as a surviving spouse)
- Completed claim form (FST-11b for Pension Plan monthly benefit, FST-11g for DROP balance, or Investment Plan Death Benefit Claim for IP accounts)
- Direct deposit authorization (Form DD-1) for payment setup
- IRS Form W-4P (for federal tax withholding on monthly payments) or W-4R (for lump-sum distributions)
Additional documents may be required for minor beneficiaries, court-appointed personal representatives, or contested designations. The Division sends a specific document request letter after the initial claim is filed.
Health Insurance Subsidy (HIS) — File Separately
The HIS does not continue automatically after the retiree's death. An eligible surviving spouse or joint annuitant receiving a continuing monthly pension must file a separate application:
- Pension Plan recipients: Form HIS-1
- Investment Plan recipients: HIS-IP packet
The subsidy pays $7.50 per year of the member's creditable service, with a minimum of $45/month and a maximum of $225/month. Retroactive payments are capped at 6 months before the Division receives the approved application, so do not forget to file it. Many families miss this entirely because no one tells them about it.

Phase 4: Wait for Processing, Then Verify (Weeks 3–8)
The Division of Retirement processes Pension Plan survivor claims in approximately 3 to 6 weeks after receiving all required documents. Investment Plan claims through Alight Solutions typically process in 2 to 4 weeks.
The first survivor pension payment is retroactive to the month after the retiree's death. If the claim takes 6 weeks to process, you receive a lump payment covering the retroactive months alongside the first regular deposit.
Social Security — File a Separate Claim
FRS survivor benefits and Social Security survivor benefits are independent. Filing one does not affect the other.
The Social Security Fairness Act, signed January 5, 2025, repealed both the Government Pension Offset (GPO) and the Windfall Elimination Provision (WEP) retroactively to January 2024. If you were previously told that the FRS pension would reduce your Social Security survivor benefit, or if you never applied because of the offset, contact SSA at 1-800-772-1213 to verify the adjustment or file a new claim. This is not automatic for people who never applied.
What You Don't Need an Advisor For
- Filing claim forms — The Division requires the beneficiary or authorized representative to sign. An advisor cannot file on your behalf.
- Choosing between Option 3 continuation and a refund — The option was already chosen at retirement. The survivor receives whatever that option provides. There is no decision to make.

- Reporting the death — A phone call to the Division and/or Alight Solutions.
