CalPERS Survivor Health Benefits: Keeping Coverage After a Death
The Two Conditions for Permanent Health Coverage
For a surviving spouse, partner, or dependent to keep CalPERS health insurance permanently after a member or retiree dies, both of these must be true:
1. You were already enrolled as a covered dependent in the member's CalPERS health plan at the time of death. Not just eligible — actually enrolled. If the retiree dropped family coverage at some point and you weren't on the plan when they died, you cannot add yourself after the fact.
2. You're entitled to an ongoing monthly allowance from CalPERS. This means a Survivor Continuance, Option 2/2W/3/4 continuance, 1957 Survivor Benefit, Pre-Retirement Option 2W, Special Death Benefit, or 1959 Survivor Benefit. The allowance must be sufficient to cover the health premium deductions.
If either condition is not met, the survivor does not qualify for ongoing CalPERS dependent coverage under these rules.
The Lump-Sum Trap
This is the single most costly mistake in CalPERS survivor benefits: a surviving spouse who chooses a lump-sum Basic Death Benefit instead of a monthly allowance (like Option 2W) permanently loses all CalPERS health coverage rights. The lump sum may look attractive in the short term, but the lifetime value of health, dental, and vision coverage through CalPERS almost always dwarfs it.

Active Employee Deaths: The 120-Day Extension
When an active state employee dies, the employing department automatically continues employer-paid health, dental, and vision insurance for all covered dependents for 120 days. This is automatic — you don't need to apply for it.
The 120-day window gives the family time to submit the survivor benefit application to CalPERS and get approved for an ongoing monthly allowance, which then qualifies them for permanent health enrollment. The extension bridges the gap between the death and the first survivor payment.
Local agency and school employees may have different continuation provisions depending on their employer's contract. Contact HR at the employing agency to confirm what applies.

Retiree Deaths: Coverage Ends at Month's End
For retirees, health coverage for dependents terminates at the end of the month in which the retiree died. There's no automatic 120-day extension for retiree families. The survivor must qualify for an ongoing monthly allowance and submit the enrollment paperwork to maintain coverage.
This creates real urgency. A retiree who dies on October 3 leaves their spouse with coverage through October 31 and potentially no coverage starting November 1 unless the survivor application is moving through CalPERS quickly.
The 120-Day Separation Rule
An additional requirement affects retired members: the retiree must have begun retirement within 120 days of separating from their CalPERS employer. If a member left their job, waited more than 120 days, and then applied for retirement, both the retiree and all their survivors permanently lose eligibility for CalPERS-administered health plans.
This rule trips up families who didn't know about it. There's no way to fix it after the fact.
Who Cannot Be Added
Spouses married to the retiree after the retirement date cannot be added to CalPERS health coverage as survivor dependents. Stepchildren not in a parent-child relationship at the time of death, and any family members not enrolled before death, are also ineligible.
The one exception: a child of the deceased member born after the member's death can be enrolled.
Dental and Vision
CalPERS dental and vision coverage follows the same rules as health coverage — prior enrollment plus an ongoing monthly allowance. The premiums for survivor dental and vision are deducted from the monthly survivor payment just as they were from the retiree's allowance.
