What Option 4 Covers
Option 4 is CalPERS's flexible payout option. Where Options 2, 2W, 3, and 3W follow fixed formulas — 100% or 50% survivor benefit, pop-up or no pop-up, one lifetime beneficiary — Option 4 handles everything that does not fit those templates.
The most common uses are court-ordered community property divisions after a divorce, custom dollar-amount or percentage splits for multiple beneficiaries, and combination plans that merge a survivor benefit with a contribution guarantee.
Court-Ordered Community Property Divisions
Under California community property law, pension benefits earned during a marriage are shared assets. When a CalPERS member divorces, the court can issue a qualified domestic relations order (QDRO) that divides the pension between the member and the former spouse.
CalPERS implements this division through Option 4. The monthly allowance is split into two separate payments: one portion goes to the member and the other goes directly to the former spouse as their community property share. The exact split is determined by the court order, typically based on years of service during the marriage divided by total years of service.
The former spouse receives their share as a "nonmember" account. They can leave it in CalPERS and draw from it when they reach retirement age, or they may elect to begin receiving payments on their own timeline by filing a Nonmember Service Retirement Election Application (PUB 44).
Filing Sequence for Divorced Members
If you have a pending community property claim, submit the divorce decree and QDRO to CalPERS's Community Property Unit well before you enter the 120-day filing window. CalPERS needs to review and approve the court order before your application can be processed.
If you file your retirement application while a community property claim is unresolved, CalPERS flags your application and processing stalls. This delay pushes back your first check, extends the gap between your last paycheck and your first pension payment, and can create health coverage complications if you are relying on the 120-day PEMHCA rule.
Start the community property resolution process at least 6 to 12 months before your target retirement date. Courts move slowly, and any deficiency in the QDRO language can require a return trip to the judge.

Option 4 for Multiple Beneficiaries
Outside the divorce context, Option 4 lets you name more than one lifetime beneficiary. For example, you might split a survivor benefit between a spouse and a dependent child, or designate specific dollar amounts for different family members.
Each arrangement requires custom actuarial calculations from CalPERS. The more beneficiaries and the more complex the split, the larger the actuarial reduction to your monthly payment. Contact a CalPERS counselor to model the specific arrangement you are considering.
Combination Plans
Option 4 also allows combination plans that merge elements of other options. For instance, you could combine an Option 2W lifetime survivor benefit for your spouse with an Option 1 contribution guarantee for a different beneficiary. The contribution guarantee ensures that any remaining unamortized employee contributions are paid to the secondary beneficiary as a lump sum upon your death.
These combinations are rare and complex. If you are considering one, work through the details with CalPERS during a scheduled counseling appointment rather than trying to set it up on the application form without guidance.
Key Deadlines
The same 30-day irrevocable window applies to Option 4 elections. After CalPERS issues your first check, you have 30 calendar days to modify your option or beneficiaries. On day 31, the arrangement locks under Government Code Section 21472.
For court-ordered divisions specifically, ensure the QDRO uses language that CalPERS accepts. The Community Property Unit has specific requirements for how the court order must describe the division — generic family law language may not be sufficient.
