TRS Illinois Undo Tier 2 — Can You Switch to Tier 1?

You started teaching in Illinois after January 1, 2011, and the more you learn about your TRS benefits, the worse the comparison looks. Tier 2 members retire later, earn smaller COLAs, and hit a pensionable salary cap that Tier 1 members never have to think about. The question lands naturally: can you undo your Tier 2 status and get Tier 1 benefits instead?

Your Tier Is Set by Statute, Not by TRS

Tier assignment under TRS depends on when you first contributed to TRS and whether you had pre-existing creditable service with an Illinois reciprocal retirement system. If you first contributed to TRS before January 1, 2011, or had pre-existing reciprocal-system credit before that date, you're Tier 1. If your TRS contributions began on or after that date and you had no such prior credit, you're Tier 2. This threshold was established by Public Act 96-0889, the Illinois pension reform law signed in 2010.

You cannot elect to switch from Tier 2 to Tier 1. The tier assignment follows the contribution-date and prior-service rules in the Pension Code, and TRS administers benefits under those rules. Even if you had prior teaching experience before 2011, that alone does not establish Tier 1 status.

What About Reciprocal System Credit?

Here's where some members find unexpected good news. Under the Illinois Retirement Systems Reciprocal Act (40 ILCS 5/20), Tier 1 status can apply if you had pre-existing creditable service with a participating Illinois retirement system before January 1, 2011, even if you started contributing to TRS after that date.

If you worked in an Illinois public library, university, municipality, or park district before moving into downstate teaching, check your contribution history and credited service with the reciprocal system.

Why the IEA and IFT Push to "Undo Tier 2"

When you see union advocacy calling for legislation to "undo Tier 2," they're talking about changing the law — not an administrative switch available to individual members today. The Illinois Education Association and Illinois Federation of Teachers have pushed for Tier 2 reform in the General Assembly for multiple sessions, arguing that Tier 2's benefit structure may fall short of federal Social Security safe-harbor minimums.

Reform proposals have included lowering the unreduced retirement age, improving the COLA formula, and raising or eliminating the pensionable salary cap. As of this writing, no comprehensive reform bill has been signed into law. A proposal does not create an individual application to change tiers; whether a future law would affect current or retired members would depend on its terms.

What Tier 2 Members Can Do Now

You can't change your tier, but you can maximize the benefit your tier provides:

Buy optional service credit. Out-of-state teaching, military service, and recognized Illinois private school teaching can all be purchased. Every additional year of credit increases your annuity multiplier, up to the 75% maximum. Except for pregnancy or adoption leave purchases, optional service must be paid in full before your effective retirement date.

Watch the salary cap. For FY 2026–27, the Tier 2 pensionable compensation cap is $129,192.26. Earnings above this threshold cannot be used in your final average salary (FAS) and are exempt from member and employer retirement contributions. If you're negotiating a contract that pushes you above the cap, the extra salary still reaches your paycheck — it just won't lift your pension.

Don't wait on reform to plan. Plan using current law rather than assuming a pending proposal will change your benefits. If a reform passes after you retire, whether it applies to you will depend on the enacted law. Planning around a bill that hasn't passed yet is a recipe for delaying retirement with nothing to show for it.
