Qualified Illinois Domestic Relations Order — How a QILDRO Splits a TRS Pension

What a QILDRO Actually Does

A Qualified Illinois Domestic Relations Order is a court order that directs TRS to pay part of a member's retirement benefit — or part of a lump-sum refund or death benefit — to an alternate payee, usually an ex-spouse. It's governed by 40 ILCS 5/1-119 and is the only mechanism Illinois law provides for splitting a public pension in divorce.

A QILDRO is not the same as a federal QDRO used for private-sector 401(k) plans. Illinois public pension systems use their own statute, and a QDRO drafted for a private plan won't work here.

Percentage vs. Dollar Amount — and the Calculation Order

A QILDRO can express the division as either a fixed dollar amount or a percentage of the benefit. When it uses a percentage, there's an extra step: TRS can't calculate the alternate payee's share until the final benefit amount is determined. That means the court needs to issue a separate Calculation Order once the member applies for retirement and TRS runs the numbers.

When a QILDRO uses a percentage, the separate Calculation Order is submitted once the affected benefit amount is known. TRS needs that order to determine the alternate payee's share; filing it late can delay the alternate payee's first payment.

The Consent Requirement for Pre-1999 Members

Members who joined TRS before July 1, 1999, have an additional hurdle: a signed Member Consent form must accompany the QILDRO. Without the signed consent, TRS cannot process the QILDRO.

Members who joined on or after July 1, 1999, don't need to provide separate consent. The QILDRO alone is sufficient.

What a QILDRO Cannot Divide

Not everything is on the table:

  • Disability benefits are excluded. A QILDRO cannot redirect any portion of a TRS disability benefit.
  • TRIP health insurance can't be split or shared through a QILDRO. Each person must establish their own coverage eligibility independently.
  • Monthly survivor benefits are excluded. A QILDRO can allocate a lump-sum death benefit to an alternate payee.

How a QILDRO Affects Payout Elections

An active QILDRO on file can constrain your payout options. If the order guarantees the alternate payee a percentage of the monthly benefit, TRS may limit or flag certain elections — like a Reversionary Annuity naming someone other than the alternate payee — to ensure the court-mandated share gets paid.

Review any existing QILDRO with TRS Legal well before you apply for retirement. If the order needs updating (new dollar amounts, remarriage provisions, or a Calculation Order), handle it early. Filing a required order late can delay the alternate payee's first payment.
