NYSLRS Retirement Mistakes to Avoid

Missing the 15-to-90-Day Filing Window

Your Application for Service Retirement must arrive at NYSLRS between 15 and 90 days before your chosen retirement date. File outside that window — even by one day — and your selected date is invalid. You'll need to pick a new retirement date and potentially delay your departure.

If you're filing on paper, use Certified Mail with Return Receipt Requested so the postmark date counts as your filing date. Standard mail relies on when NYSLRS receives the envelope, and a three-day postal delay can knock you out of the window.

Filing through Retirement Online avoids this risk entirely — the submission timestamp is your filing date.

Retiring With Unpaid Service Credit

Submit requests to purchase or transfer service credit before retirement. Any mandatory service-credit purchase balance must be paid in full before your effective retirement date; an unpaid mandatory balance at retirement causes a permanent actuarial reduction to your monthly pension.

Check your Retirement Online account for outstanding balances at least six months before you retire. If a purchase remains unpaid, ask NYSLRS how it will affect the credit and your benefit.

Assuming HR Files Your Application

Your employer's human resources department does not file your retirement application with NYSLRS on your behalf. HR handles payroll separation, sick leave certification, and health insurance paperwork. The pension application — Form RS6037 or the Retirement Online submission — is entirely your responsibility.

Members who assume HR takes care of everything sometimes discover at 15 days out that nothing has been filed.

Forgetting Beneficiary Proof of Age

If you elect a Joint Allowance or Pop-Up option, NYSLRS requires official proof of your beneficiary's birth date before they'll process the election. Acceptable documents include a birth certificate, passport, or New York State driver's license.

This requirement catches members off guard when their beneficiary is a spouse who was born outside the U.S. or whose birth records require extra steps to obtain. Start gathering beneficiary documents months ahead of time.

Submitting Unnotarized Paper Forms

Paper Form RS6037 requires a Notary Public signature. Submitting it without notarization means it's not properly executed, and NYSLRS will send it back. By the time you get it notarized and resubmit, your filing window may have closed.

Retirement Online bypasses this requirement — another reason to file electronically if possible.

Ignoring an Old Domestic Relations Order

A Domestic Relations Order from a divorce — even a decades-old one — can restrict your payout option election, mandate that you name an ex-spouse as irrevocable beneficiary, or require a specific percentage split of your benefit. If NYSLRS has a DRO on file and your option election conflicts with it, processing stops.

Contact NYSLRS early to confirm whether any DRO is on file for your account. If you've been divorced, locate your Judgment of Divorce and any court orders mentioning pension benefits.

Letting the 30-Day Option Window Expire by Default

After retirement, you have 30 days from the first day of the month following your retirement date to change your payout option election. Many new retirees don't realize this window exists, or they treat it as something they'll "get to later."

Once the window closes, your option is irrevocable. Set a calendar reminder for the deadline and use the full window to review your estimate against your actual needs before the election locks in permanently.
