Does Divorce Automatically Revoke an NYSLRS Beneficiary Designation?

After a divorce, check the NYSLRS beneficiary record rather than assuming it changed automatically. A certified Domestic Relations Order (DRO) on file can affect the result and may supersede a later beneficiary form.

What a Domestic Relations Order Does — and Doesn't Do

A Domestic Relations Order (DRO) is a court order issued as part of a divorce that can divide pension benefits between the member and the ex-spouse. A certified DRO on file with NYSLRS can require the system to name the former spouse for specified benefits.

A certified DRO on file that requires a former spouse to be named for an active ordinary death benefit, post-retirement death benefit, or joint pension option supersedes any later beneficiary form. Because the DRO may control despite a later designation, review the order with NYSLRS and a matrimonial attorney before relying on a new form.

The Option Beneficiary Is a Separate Problem

For retirees, the most dangerous scenario involves the option beneficiary — the person named on the retirement option election form (RS6399 or RS6400). If the retiree elected a Joint Allowance and named their then-spouse as the option beneficiary before the divorce, that election generally becomes irrevocable after 30 days past the end of the retirement month.

Under that election, the ex-spouse receives a lifetime monthly pension after the retiree's death, even if the retiree has since remarried. The new spouse gets nothing from the option continuance. After the 30-day change period, the retiree generally cannot change the option or beneficiary; NYSLRS may change an election to comply with a certified DRO or other qualifying court order.

If the option beneficiary predeceases the retiree, a Pop-Up Joint Allowance returns to the Single Life Allowance rate. Under a standard Joint Allowance, the retiree keeps the reduced rate and no option continuance is payable to that beneficiary.

What Survivors Should Do

If you are the current spouse of a deceased NYSLRS member or retiree who was previously divorced:

  1. Request the beneficiary designation on file. Call NYSLRS Survivor Services at 1-866-805-0990 and ask who is currently designated. NYSLRS cannot disclose this over the phone due to privacy rules, but once the death certificate is processed, claim packets are mailed to the named beneficiaries.

  2. Ask about any DRO on file. If a DRO was filed with NYSLRS during the member's lifetime, it will affect how the death benefit is split. NYSLRS is legally bound by the DRO.

  3. Understand your rights even if you're not the named beneficiary. A surviving spouse may have separate claims under the Survivor's Benefit Program, NYSHIP dependent survivor coverage, or Social Security. Confirm the applicable eligibility and payee rules with each program; these are separate from the NYSLRS pension beneficiary designation.

How Members Can Prevent This

Active members and retirees who have been through a divorce should:

  • Review the RS5127 (active) or RS6439 (retiree) after divorce and update it if appropriate, after checking whether a certified DRO limits the change.
  • Review RS4471 for the post-retirement death benefit if already retired, including any applicable DRO terms.
  • Review the option election. After the 30-day change period, an option election is generally irrevocable, subject to NYSLRS's authority to comply with a certified DRO or qualifying court order. A Pop-Up Joint Allowance provides some protection — if the ex-spouse predeceases the retiree, the benefit "pops up" to the full Single Life Allowance.
